Bill To End Off Duty Carry For Peace Officers In NYS?

I don’t want this to turn into a LEO bashing party...

I heard a rumor that a bill was introduced to end off duty carry for all peace officers in NYS. I was directed to this bill. I think it is all rumor and a panic because I don’t see anything in this that changes off duty carry. I’m hoping somebody here with the legal know how can shed light on anything like that. Like I said, I see nothing in here. I see re-structuring and re-organizing. Somebody also said that the Governor said to tack it onto the budget? I think it’s all BS to be honest...

I only skimmed it. Looks like it clarifies in detail who is or isn’t an authorized peace officer in regards to exemptions. This was probably written to deal with issues that have come up regarding LEOSA.

AFAIK this is just about the opposite of what the OP title suggests.

It appears some Republicans in the Senate drafted a few pieces of legislation to expand the scope of the Peace Officer definition, to give a larger population of those who carry as part of their public service job assignment (such as certain baliffs and deputy sheriffs), similar off duty carry provisions already afforded many other peace officers. This appears to be one of the bills and there are others listed as links on multiple NYS Senators' pages of legislation they are sponsoring.

The bill was amended. They removed “pursuant to special duties”. Nothing will change.

Most Peace Officers cannot carry on their badge for example.

Most Peace Officers cannot carry on their badge for example.

The main difference is arrest powers and Terry stop powers. A police officer can enforce felony, misdemeanor , violations , and petty offenses with probable cause . Peace officers can enforce felonies and misdemeanor offenses on probable cause and other offenses with in their special powers.

Most peace officers can not do a “Terry stop” on reasonable suspicion.

And if outside their special powers, they are not obligated to make it attempt an arrest in a felony situation as a police officer would.

A peace officer acting in their special powers have more power than a police officer in many cases. A parole officer can search a parolee’s house without a warrant where a police officer would need one.
