The Serbu Super Shorty, is not treated as a smooth bore pistol.. It is still treated as an AOW and requires a $5 tax stamp and form 4 to transfer. That is in addition to NYS requiring that it be added to your permit..
The Serbu Super Shorty by the BATFE's "legal" definition is an AOW, because it is less than 26" in length, has a VFG, and a smooth bore.
The Black Aces Tactical does NOT meet the BATFE "legal" definition of an AOW because it is greater than 26" in length
Nor their "legal" definition of a pistol because it has a VFG, and a smooth bore (by Definition a pistol CAN NOT have a smooth bore (it would be considered an AOW), and the second you put a VFG on a pistol it becomes an AOW.
Nor does it meet the "legal" definition of a Shotgun, because it has a barrel less than 18" length
Nor does it meet the "legal" definition of a Short Barreled Shotgun, because its overall length is greater than 26"
So that leaves it in the grey area of "Firearm"..
There is not NFA restrictions on "Firearms", therefor it can be transferred on a 4473 without a tax stamp..
I hope I thoroughly confused you and showed why the NFA and BATFE are garbage that should be done away with..
