US Supreme Court's Alito temporarily blocks 'ghost gun' ruling

U.S. Supreme Court Justice Samuel Alito on Friday temporarily blocked a lower court's decision to strike down a regulation aimed at reining in privately made firearms known as "ghost guns" that are difficult for law enforcement to trace.

This is Garland v. Vanderstok the ATF ghost gun/buy-build-shoot rule. Doesn't immediately affect NY due to our idiotic state-level laws but it could touch on their constitutionality.

Here's the Supreme Court's emergency stay on the 8th:
Application (23A82) for stay presented to Justice Alito and by him referred to the Court is granted. The June 30, 2023 order and July 5, 2023 judgment of the United States District Court for the Northern District of Texas, case No. 4:22-cv-691, insofar as they vacate the final rule of the Bureau of Alcohol, Tobacco, Firearms and Explosives, 87 Fed. Reg. 24652 (April 26, 2022), are stayed pending the disposition of the appeal in the United States Court of Appeals for the Fifth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought. Should certiorari be denied, this stay shall terminate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of this Court. Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would deny the application for stay.

In summary, the Supreme Court boned us with a stay again. The ray of light if there is one, is that there were four dissents. Four dissents on the emergency docket is a bit unusual in a case like this. The posture of the case is good too. The FPC won at the district level in summary judgment (which is a FINAL judgment) and won an injunction on appeal to the 5th circuit panel. This means this panel is almost certain to affirm the district court. We can assume the ATF file a writ of certiorari, in which case the stay will stay in effect, but if the supreme court denies cert, then the rule stays struck down. If the supreme court grants cert, then they just need one more vote (looking at you ACB!) to affirm on the merits.

I don't think that there would be an en banc reversal in the 5th circuit. Assuming ACB doesn't join Roberts with the liberals to screw over gun owners this time, the ATF rule should be history. That would be a good precedent but I wouldn't get my hopes up for it helping us in New York real soon.
