Based on the ID you show, the FFL can only transfer you a gun that is legal in the state you are buying in, AND can only transfer you a gun that is legal in the state that your ID states you are from.

So the gun must be legal in both states.

Thanks, I found the section of 922 that applied and edited my post. Shame on me for not doing my homework and not knowing this already as it's pretty important.

Begs the question though. There's an exception for sales nonimmigrant aliens that they can buy guns if they're admitted for hunting or sporting purposes or have a hunting license. I understood that anyone here on a visa waiver or visa (even a tourist) that's picked up a hunting license could then buy a gun (presumably to hunt with, although the law doesn't specifically seems to require that). How would this fit into the other restriction on interstate sales of long guns to someone that's a nonimmigrant alien and doesn't have a home state? And probably comes from a country where they aren't allowed to have any guns? Seems like it wouldn't apply and that a foreign tourist in Wyoming to hunt elk can buy guns that a New York citizen can't. Which is pretty fucking stupid.

In practice I understand most FFLs would be leery about selling to an alien who checked the nonimmigrant alien boxes (and probably wouldn't do it), but I understand there are some outfitters who cater to that.

IE. You but a NY legal Mini14 ranch in Florida and add a vertical grip to it. If coming back to NY, that vertical grip has to come off.

Makes sense. It would be nice to be able to take my Mini14 to PA and be able to shoot with a normal sized magazine.

BTW I found this straight from the ATF which confirms part of my reading of the law about aliens and hunting licenses:

So it seems some Japanese tourist flying in on a visa waiver under the law as the ATF describes it could buy a varmint hunting license online for North Dakota and go to PA and buy a full-featured AR15 to shoot while they're there, that us New Yorkers have no way to legally acquire without moving to a free state.

I guess we can legally "acquire" it as you say by going backwards by modifying it from NY-legal configuration to proper configuration while in a state where it's legal. A restriction that seems not to apply to foreigners.

Edit2: lest I spread misinformation, in separate questions it's indicated that nonimmigrants can only buy firearms here for direct export. they can only buy ammo and rent firearms here, or bring their own in with a permit. so they don't really have any more gun-buying rights than Americans.

No problem there. No ID or background check needed to buy magazines.
You should be able to walk into any LGS in PA and pick up Ruger 20 rounders as long as they stay out of NY.
