Buffalo man arrested on armed robbery made a reference to the Buffalo mass shooting

This is what’s wrong with NYS and why crime is rising. This man robbed a store at gun point and then makes a threat(seemingly) that they normally would classify as a hate crime and gets referred for mental health checks. If he completes the program it will be knocked down to petit larceny and he was released on his on recognizance. What am I missing here? This makes no sense to me at all.

Not excusing the scumbags actions here but I didn’t see anywhere in that article about him having a gun. I think he just used the Tops shooting incident that was so recent to scare / threaten the cashier.

So, he's nuts enough to be moved to the mental health court where he can play the game, and be a good boy to plead down his case to next to nothing, but sane enough to be let go with a smile and a wave.... Um, ok then....
