Also, the judge who said this would have to be sold through an ffl or pharmacy never mentioned anything about concentration or if it was considered pocket sized, my guess he figured the pharmacist or ffl would figure that out.

I see now. They will ship the solid balls and the inert powdered balls to all of NYS except NYC area but nothing pepper related to all of NYS. Likely the pepper concentration is too high plus the stupid laws.This site link certainly has the restrictions listed

I would definitely say it’s good to go in NYS the only thing that might not be good to go is the pepper balls. Nys restricts the level of pepper in the pepper spray and as far as I know it’s like half what the police use. These are pepper balls though so not sure if they even regulate pepper balls maybe just the sprays.
On a side not I’m normally not a fan of less lethal options. I feel they hinder you. Say if you go less lethal and they pull a gun after just threatening you. Then you have to drop this and draw your gun. Also many reports of pepper spray and tasers being ineffective against people under the influence. With that being said I like this one as a less lethal option. Will I get it no because I wouldn’t carry it. It’s would be like carrying two guns. Kimber used to make a small pepper blaster I’d consider getting.
They make one gun shaped too. Same thing though I’d check the % of pepper to be sure it’s legal.

You would have to ask the manufacturer why they don't deal with NY and CA. It could be they don't meet existing requirements / limitations (e.g. concentration, size, etc), it could be their legal advisor / insurance advisor, it could be they were already threatened by litigation by NY. Your guess would be as good as mine. Let us know if the manufacturer tells you but they would not give a specific reason to those I know who already asked the manufacturer.ok so why not ship to FFL in NY ?

Why would you want something that size with limited effectiveness when you can get a can of Saber or POM OC spray.
