Trump is currently changing the makeup of the 9th to lean more conservative. Stay tuned. Hopefully he will do the same for the 2nd circuit and other liberal leaning courts.

If you can't see that you have to appoint judges of your own party, then you can't see corruption. You should be able to appoint any person no matter what their former party affiliation. A circuit judge is supposed to rule as per the Constitution. Not by party lines.

There would not be a split in the courts. If the 9th circuit overturns the California district court's decision, then there would be AGREEMENT between the 9th and 2nd circuit courts.

If the 9th circuit upholds this current ruling that magazine bans are unconstitutional then there would be a split.
The 2nd circuit has never said that magazine bans are unconstitutional, if they did then we all would have whatever mags we wanted here in NY

With that said, we have no hope in NY alone unless some corrupt judges croak and Trump gets to appoint conservative ones (gonna have to google the 2nd circ). Our only hope is cases in other states that make it to scrotus, it would be great for a mag capacity case to get to scrotus.

I'm at a loss here. The same judge who ruled the mag ban unconstitutional has stayed his own ruling because of an impending appeal by the state? Did the state appeal? Are they planning to? Why wouldn't his ruling remain until it was appealed and overturned? Talk about punching yourself in the nuts.

Seems almost like they wanted to set people up. Have thousands of people buy literally tons of standard cap magazines for a week or so and then figure out a way to find the people that bought them. Hmmm.

But the ruling also clarifies that the injunction against those restrictions will remain in effect “for those persons and business entities who have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds between the entry of this Court’s injunction on March 29, 2019 and 5:00 p.m., Friday, April 5, 2019.”

So...this must mean that the state of CA has expressed its intent to appeal the ruling.
I'm betting on the 9th circuit overturning the district court decision. Then....the original plaintiffs could appeal to SCOTUS. Good....friggin....luck.
