Can you use a passport to purchase a gun in NY

Hey everyone, my brother has the gun bug and wants to purchase a fire arm this week. Problem is he doesn't have a license. He has a valid US passport and Valid US passport card, and proof of residence in NY. Will he be able to purchase a gun a rilfe or shotgun using a passport and proof of residence or should he wait until he has his valid NY license in hand... back story he moved from California back to NY for work. He's lived here for about a year which is enough time to establish residency. Just dont want him to get his hopes up if this cannot be done... Any FFLS on here have any input.

It will also depend on the FFL. I had a P.O. Box as the address on my license for many years and the FFLs would usually require some supplemental ID showing proof of residency. I started carrying my property tax bill with me to gun shows and I think only once did an FFL have reservations. I usually throw a couple more address identifiers in my bag when traveling to gun shows especially if they are far away (utility bill, homeowners ins. bill, etc. all with the address on them). Once my local FFL got to know me they never asked for supplements for address. Now my license has my physical address (I think a CDL now requires that it does) and I haven't had any issues.

Well, the Enfield was a piece of crap.
The barrel wobbled when you shook the gun.
Brought it to my gunsmith who put $200 worth of parts and labor into it and it now shoots fantastic.
Part of the price of fixing it was the original flip up sights which go to 800 yards........but you cannot even see the target at 800 yards......bit of engineering there.

Shouldn't be a problem at a LGS. Stores like WalMart or Dick's will not accept it because they have to conform to a very narrow set rules.

This is true. The employees at the big box stores often either don't know the laws regarding transfers or operate under more oppressive store guidelines or both. Before I began boycotting Dicks I once overheard a gun dept. employee stating some misinformation to a customer about how you can't buy or sell a long gun to someone from out of state. I informed him that it is perfectly legal to transfer rifles and shotguns to someone from another state. No, it's against the law he replied. The big corporate stores teach these inaccuracies to avoid any legal troubles. LGS and other FFLs know the law and follow it without adding additional burdens. Buy Local.

Doesn't he have a NYS Driver License or ID Card? Supposed to turn in (CA) old DL for new one within 10 days per NYS Law when moving here.

He doesn't have a NY issued ID. Hence me asking But as advised on this thread we had no issues this morning, we to a LGS in upstate NY today and both purchased new guns. I got a DB AR10 and he bought a SW M&P. He used his valid US passport and vehicle registration he also had supplemental proofs of residency. Renters insurance policy, bank statements, W2. But the FFL only wanted the photo ID and vehicle registration. FFL said it was more common than we thought and they have a list of items that the state deems sufficient to prove residency. Apparently a Medical Marijuana card is one of them.. Go figure

Awesome! Medical Marijuana Card is valid? Form 4473 has a disqualifying question on it regarding the use of marijuana even medically prescribed. If someone used the card and checked that box yes I would think they would be denied. Using the card and checking no you would be lying on the form which I think might be a felony. I guess someone could argue the they got the medical marijuana card to use as a form of ID so they could purchase a gun!

Technically I suppose you could be prescribed the pot and get the card, but never actually buy or use any and it'd be legal on the 4473.

Many of the people working at these places dont know the difference between store policy and the law.
For instance the Walmart employees who say its illegal to buy pistol caliber ammo without showing your pistol permit.

I too only have my PO Box on my license. I wrote in black sharpie my physical address on the back of my license under the change of address section. That's always seemed to be acceptable wherever I went. My Pistol Permit has my physical address on it (and I carry that everywhere) and that's always been accepted too.
