Take this for what it is because it’s a different situation and only one or a couple cops interpretations. A friend of mine is a sergeant in the state police and last fall we were at a cook out. He was talking about the problems they have working with the fake Indian police force. He started in on this story where he was made aware of a tribal police office was going to confiscate a legally owned firearm because they were carrying on tribal lands. He told the tribal police officer if he took the fire arm he would arrest him for theft and an illegal gun. The tribal officer didn’t have a NYS pistol permit. I said I like to fish and sometimes drive through the Indian reservation carrying my gun is that good or bad. He said don’t worry and call the state police of you get in trouble on Indian land they have no right to take your gun. He said this guy was literally just looking to take a gun and keep it. Not sure how legal/valid this story is but that’s what I was told. There were 3 city cops there and 2 state park police officers there. No one disagreed.

I didn't see the rule where if you were to ask for input here you are not allowed to seek information from any other sources. Please cite the exact rule.

The only response that was "argued" was a silly, tired, over used response suggesting that "concealed is concealed - nobody will ever know" which was not the point of this thread. Legal is legal and illegal is illegal. You choose your own path at your peril.

I'm not sure if you've read through this entire thread but I've uncovered lots of information showing that what they told you is completely incorrect. What they said might apply to tribe members, but not anyone else. Also, they cannot procure you. You would have to be prosecuted by the feds. Such a law does not exist.

Penal law 400-6. License: validity. Any license issued pursuant to this section shall be valid notwithstanding the provisions of any local law or ordinance. ...A license to carry or possess a pistol or revolver, not otherwise limited as to place or time of possession, shall be effective throughout the state...

Although OP said to ignore this, it's worth mentioning if you are caught by the management and banned from that casino you are in practice banned from almost every other casino in the US. The casinos regularly share the data on banned guests and use facial recognition to find them.

We all get that. The unique question here is if an Indian casino would operate under some tribal law, subjecting you to possibly committing a felony type crime. We all go places that "suggest" that we don't carry. In those situations there is no risk of legal action, so it's a no-brainer.

Not an attorney but I would say the first hurdle is whether they want to press charges, make a stink about it, or simply ask you to leave.....and maybe never come back.

Nothing to press charges for. Hurting feelings or declining a request is not in the penal law. Being asked to leave? Sure. I'm ok with that. Just wanted to make sure it was a lawful activity.

I got the impression from my cop friends that were talking about this that basically they would confiscate the gun and it would never be logged into evidence. Basically they would steal the gun from you and what would you do about it? Are you going to call the county and tell them so and so arrested me and confiscated my firearm because I broke a tribal gun law? No. So it’s a great way to get away with them “legally” stealing your firearm.
The conversation even specifically said they need a NYS pistol permit or he would have arrested the tribal officer for illegally possessing a gun. Im guessing he was unarmed tribal officer??
Take note her they call them first responders and Marshall’s. They don’t call them police officers or peace officers. I’m guessing they have no power of law outside the serve ration. They also say they uphold the reservation constitution.

Yes, because the tribal law doesn’t apply to me and the county or state police cannot arrest for something not in the state penal law. Also someone stealing a firearm from me would supersede any nonsense tribal violation they came up with. My permit is good throughout the state “notwithstanding (despite) local laws or ordinances”.

Casinos have security which could detain you for trespassing, which you would be doing if you disregarded their posted signs. They could likely press tresspassing charges immediately as you had been afforded warning via the posted signs.

Not the casino I go to. But they aren’t on tribal land.
