Typical gun owner mentality.

I had a customer of mine called me after said his gun was at the state police barracks can I please pick it up.

His compliant A.R. 15 with stone from his house. The police arrested the perpetrator recovered to gun. The gun was no longer compliant. Wouldn’t you know,? The criminal modified it into an illegal configuration Wow! whodathunk?

It was required that I pick up the firearm because it was no longer legal, in that configuration, for the civilian to own.

the police were very nice and friendly. The had no problem returning the individuals property. They were just concerned that it was returned in a legal fashion. (Enter FFL).

It was no big deal. The police didn’t drag the legal gun owner out of his house, they did not search his house, do not tear apart his car, they did not beat up his wife, they do not kill his dog, they did not smash in his front door, I did not make the sky fall on his head, the owner did not have to hire a lawyer, nobody was arrested except the criminal.

It was a regular respectful responsible returning of personal property in a timely fashion.

I am in possession of said firearm, only days or a week after the incident.

See? Not a horror story that chicken Little is so worried about.

PS. I comment to the trooper that i appreciated the fact it was so easy on everyone. His response was he is never worried about gun owners.....he worries about “non gun owners” with guns. (Chicken little......he is ayung that legal gun owners are AOK in his book and criminals are not! Oh! Chcikcen little, notice that the legal gunowner was NEVER treayed as a criminal?)

Edit to add.......the only bacon i would worry about are thos two asshats that harass us here. @Airborneguy @GOPerfect lol. :ROFL::ROFL:

The fact that needs mentioned, because all that stuff has happened, is where you should place your wager.

You might get a good, pro gun cop. I'm not willing to chance it. I don't know them, they don't know me. Keep it that way. I'm going home to my family at night.

I had to argue with an ADA today over some gun issues. We removed a Mini 14 last night (among others), for a domestic assault case. Long story short, ADA was convinced that the Mini was good for a felony charge. I argued otherwise - lost to them temporarily, because you know, they are lawyers and I am not - then an hour later my cop sends me the complaint. Sure enough: administrative code for no NYC registration. Not even a misdemeanor.

Sometimes cops even do right by actual perps. ;)

for what its worth why would anyone expect that the citizen should be in trouble in a case like this? clearly his gun was stolen, and the criminal modified it. I don't see any chicken little story here regardless. although I will say that personally its bullshit that an FFL had to become a middle man. They should have returned his gun to him, and considering the BS laws we have to deal with he should then been given a grace period in which to modify or register the rifle. At this point, he may has well register it and keep all the features because they know he owns it now. No sense removing features to avoid registration.

theres nothing saying that onces its registered that you cant modify it and sell it (that I know of). And really, I wouldnt register no matter what, but its the simple point that this state is so fucked up that the troopers didnt give him back is own property. he should have been given it back, and at worst been told he has a deadline to modify or register. to force a dealer to have to take it, and theoretically pay to modify it and get it back is complete bullshit.

You can't paint one NY law enforcement officer and or his barracks to all NY law enforcement officers and or his barracks or precinct with the same brush.

The situation may have been different in a better way in another county or much worse in another county. I'm pretty sure it wouldn't have gone down that way in Suffolk County.

Most officers don't bother with this but some do. You guys remember Lockport? What about the guy who got arrested with a legal SKS? How about the one that the divorce lawyers represented who had an MR2 installed. How about Albion and the Bullet Button fiasco? How about the ones that say the modifications must be permanent? How about Troop F? What about the police in Nassau (Kathleen Rice I think) who made a gun shop close down because they slammed buttstocks on the ground to break the blind pins to make them collapsible again?

They can’t return to The original owner now because is not compliant so you can’t give somebody an illegal gun. That’s why I have to pick it up.

I only said something about kicking in the door and drag him out shooting to die because that’s with the chicken Littles always talk about. And that didn’t happen.

When was the rifle purchased? Was it purchased unsafe compliant? Would the situation be the same if the rifle was purchased pre unsafe and the owner modified versus registering?

I understand all that in regards to not being able to return it to him in that configuration.

My response is to your insinuation that because of the way these particular law enforcement officers handled the situation, all law enforcement around the state would react the same. That clearly isn't the case.

They could have took the upper off the lower and handed him 2 compliant parts, could have let him install a new mag lock or whatever gadget he was using to make it compliant, ...

It was nice that they only made him hire a professional to get his stuff out of lock-up and to re-modify it to be pee-on legal again. A few hoops to jump though is better than a lot of hoops. :rolleyes:

They give the guy back his stolen property and say, "BTW, that rifle isn't NY compliant in its current configuration. Have a nice day."
After all they're pro gun, anti safe act, hate Fuacer and other such stuff like that.
