Ciminelli Barred From Firearm Possession
Developer Louis Ciminelli last month was ordered by a federal judge to surrender a firearm purchased and registered under his wife’s name as he faces trial in a bid rigging and bribery case.

The order, signed by U.S. District Court Judge Valerie Caproni, ordered Ciminelli to surrender the firearm pending the outcome of the case, which includes fellow developers, former aide to Gov. Andrew Cuomo Joe Percoco and ex-SUNY Polytechnic President Alain Kaloyeros.

Caproni ruled Ciminelli had provided “wholly inadequate reasons why this newlyacquired firearm should not be surrendered, consistent with the bail conditions established for his release.”

If he did not like them he had the ability to refuse them and stay in Jail.

Certainly if he purchased a fire arm in his wife's name to circumvent his Bail release agreement then he should of been hauled right back in and leave the new gun he bought his wife with her.

The judge should have revoked his bail agreement and put him were he belong in jail awaiting his trial .

The day his wife gave up her 2 nd amendment rights was the day his attorney and himself agreed to his possible bail release of (Again I have not read it but assume )

Regardless of what they are once you agree to them,and you violate them you risk having your bail revoked. the Judge was kind he should have revoked the bail to let him know they are onto his mischievous ways

I understand now, it was a negotiated deal. I wonder if the DA investigated his wife to determine if she owned firearms, although this is Erie County and she probably showed up as a co-registered handgun owner on their permits.

You very well may be correct.

I just hate when Judges take it upon themselves to strip a Constitutional Right. Why only the 2A? Why not the Right to vote as well.

Sure, he agreed to it, probably; still does not make it right.

This is the law system as we know it, when you are charged with a crime you are put in jail. With the promise of a speedy trial and you sometimes have the ability to bail out with restrictions ,and then the state has to prove its case to a Jury of your peers. once convicted and then sentenced you bail is revoked and your sent to prison for your crimes.

You are innocent of those crimes until proven guilty. Doesn't mean your life is not altered
