HTF can this even be considered self defense. Her life was not in any danger. You or I would be in jail for life ny now.
I actually don't get what you fellas don't get. It makes sense to me, at least after reading the facts.
“Technically it’s called the defense of justification and your justification is you are saving the life of another person,” Kevin Jamison, author of Missouri Weapons and Self-Defense Law, said.
"Meanwhile, Taylor's girlfriend, who had been sitting in Taylor's vehicle, had exited the car and begged Santi to stop wrestling with Taylor.
"Stop, sir, stop," she yelled. "Get off! My kids [are] in the car! Stop! [You’re] killing him!""
"“The girlfriend is only constrained by what she reasonably believed to be the circumstances. If she didn’t see the start of the fight, all she knows is her boyfriend is getting strangled.”"
“If a case is declined, it’s just because we don’t believe there’s sufficient evidence to get to that highest burden of proof,” Peters Baker said.
It's kind of an 'everyone sucks here' situation, maybe including the guy who got shot, but is it really so hard to understand why she isn't being charged ? If you got out of the car and found someone strangling your wife.. pretty sure you'd reasonably believe her life was in danger and do whatever was in your power to do to stop it; at least I'd hope so.
The felon is being charged with the weapon, which is of obviously correct.
An off duty fireman wrestles a felon to the ground in Missouri after the felon pulls a pistol on said fireman.
I'll mark you down good he's dead.actually its
a off duty fireman wrestles a guy to the ground .. the guy on the ground pulls a pistol
no fkin way the fireman knew he was a felon unless they were roommates
"When guns are outlawed only outlaws will have guns."Im going to become a criminal, they have way more rights than a law abiding citizen .
and apparently, crime does, in fact, pay
Nails it.This is terrible, but it shows a couple of different things.
A) our immediate bias knowing all the facts available post incident that were not available in that split second
B) the danger of getting involved in a 3rd party incident ( for both the firefighter during the clerk's dispute and the felons girlfriend)
C) while not defending the felon in any way, the tendency to place immediate value of one individual over another even though it's irrelevant in that moment
D) interpretation of the law can work for or against anyone.
He wasn’t trying to apprehend him to have him arrested . The felon escalated to a fight.City firefighter steps in to remove angry customer and acts like LEO in the parking lot .. not his job ..
The felon pulled the gun on the fireman.actually its
a off duty fireman wrestles a guy to the ground .. the guy on the ground pulls a pistol
no fkin way the fireman knew he was a felon unless they were roommates
So to typically over analyze this I want to get this straight. Felon is arguing with store clerk in the establishment. Firefighter steps in. Firefighter and felon continue arguing outside establishment. Felon pulls firearm. Struggle between firefighter and felon ensues over firearm. Firearm is taken by felons girlfriend. Felons girlfriend shoots firefighter in the back, killing him while they continue to struggle on the ground. The felon pulled the gun on the fireman.
“The court document shows Taylor pulled a gun and the two men started fighting over the weapon”
It had nothing to do with his felony record.
