Cops search house after fifth-grader’s BB gun shows up on webcam during virtual school session

Could you sue the principal and teacher personally ?

Unlike police I don't believe they have qualified immunity.

The school or union would probably cover their legal costs, but not any settlement.

You may be able to but they probably wont have much money.

She let them in the house. She consented. They did not go through the process of a warrant.

She should have told them no. C'mon man, exercise your Rights. While I think this search is fucked up, I blame the school for this extreme over-reach and I blame the mother for not exersing her Rights. Just say no!

This is what I was going to point out. I had a visit from a cop. I met him at the door and opened it. I stood in front of my door with my body in the doorway and my hand on the door knob. If he asked to come it the response would have been a no. We had a quick conversed he left. No issues.

She should have said no we have no guns in the house. My son has some BB guns on the wall wait here and I’ll show you them. Let the cop make the next move but don’t consent to him coming in or a search ever.
Also of course your private property can’t be equated to school grounds. At least they were descent with her and didn’t try to find charges and all that bullshit.

Well, if they get a call to "investigate", by all means; investigate.

Simple....

Go to the house.

Knock on the door.

Introduce themselves.

Explain why they are there.

Tell the mother about the over reaching school personal.

Ask the mother if all is good in the home.

File the incident report with very basic information.

Nothing was found, no search was needed. Go onto the next call. No harm, no foul.

At that point, the mother knows what kind of assholes are running the school that her child resides at!
