So he freely admits the president can rescind previous presidents executive orders, but now claims he must provide adequate legal reason to do so. FML, the courts are out of control. What once was considered a system of checks and balances has now become little more then appointees playing dictator over the entire country. My biggest fear is that if this is not rectified in the near future, a day will come that the courts will be stripped of most of their power, and we will lose the protection they were initially designed to provide. The pendulum can not swing in one direction for ever, and the further it swings in the current direction, the further it will swing back when it finally changes direction.

Actually, the original DACA policy may have been unconstitutional. The concept was based on the idea of "prosecutorial discretion" by the executive branch. The Obama administration decided not to pursue deportation against the illegal alien children (Childhood Arrivals). Although prosecutorial discretion has been accepted practice on a case-by-case basis, once the Obama administration utilized it as an overarching policy to cover an entire class of people, they were creating a defacto law. That is unconstitutional.

The Obama administration tried to put forth an adjuvent program called DAPA that would have given legal status to parents of illegal alien children. This was ruled unconstitutional:

The unconstitutionality of Obama's actions were confirmed when Obama tried to implement a second, similar program in 2014 called the Deferred Action for Parents of Americans and Lawful Permanent Residents program, or DAPA. Like DACA, DAPA provided an administrative amnesty for illegal aliens who came to the U.S. as adults and gave them work authorizations and access to government benefits.

The Fifth Circuit Court of Appeals upheld a nationwide injunction against DAPA, which the Supreme Court allowed to stand. As the Fifth Circuit said, the fact that the president declined to enforce the law and remove illegal aliens "does not transform presence deemed unlawful by Congress into lawful presence and confer eligibility for otherwise unavailable benefits based on that change."​

BUT Obama stated often that he did not have the right to do that because it was against the Constitution. For awhile that was repeated often. But recently no one seems to recall those remarks.

He basically can’t. The heart of the program is allowing people to stay here who are dependent on the welfare of the state. Big welfare goes against the fundamentals of conservativism.

The real problem is justice shopping, and lower courts making rulings inconsistent with higher court direction!

If the fucking SCOTUS won't shut the program down, and pretty much refused to do so and issued direction for the legislative branch of Gov't to get their shit together as the "only" way to circumvent executive privilege (ie, create a LAW)... Then this Judge should be removed as the ruling is purely 100% political!!!
