Ideally there should be reprocussions for legislators who pass laws in violation of civil rights and already existing law, but there isn't.
The Safe Act is one gross example of how legislators can pass something in defiance of the Bill of Rights and have it stick.
The judicial branch cannot proactively strike a law down, it needs to be brought before them via lawsuit. I would imagine it would work the other way with state or local government acting in defiance of federal law. The feds would have to bring suit, otherwise it would stick because no one is enforcing the law or suing for a violation of the law. Like the states that legalized weed and the Obama Justice Dept. that did nothing about it.
It would never happen but it would be spectacular to see the AG file suit against Deerfield in this case.
