Better late than never?
I guess this is better than charging the guy while they investigate. Either that or it is better than the DA saying, "You're good to go, no charges" then six months later come back and say he made an error and has to charge a crime.
Glad he is free and clear though.

The wheels of justice turn slowly. Heard an interview of a guy who had someone aggressively approach and then climb onto his semi. This guy just yelled back off, I've got a gun. He didn't have one at the time. The other guy who approached and climbed on his rig left and made 1 call to 911. Took a year to get cleared of charges. Never heard from the guy who called 911 again.

this is why after any incident, YOU SHOULD CALL THE POLICE, generally speaking, the first one to call 911 is the victim.....generally.

God damn right! I personally experienced that too. Last year, my ex and her boyfriend (whom I have filed police reports of his threats against my life with the OPPD) showed up at my house after having been told not to come to my home in writing, and then started screaming about my "having a gun on me" (I did in fact, and it was concealed, and it STAYED concealed, and was never disclosed of by me IN ANY MANNER). We both called 911, but she got though first! And what do you know: the DI report lists her as the complainant, and me as the respondent...
No arrests were made, but my hypocritical local PD Chief wrote a letter to the PPO demanding that my permit be revoked because HE, the Chief didn't like me having one (after the incident at my home, which I did absolutely nothing to start, or during the actual incident). My permit was suspended by the PPO after he sent his letter, and I had to turn my guns in while having no idea why, as I had broken no laws and had not been arrested. I had to hire a lawyer, and go to court (still having NO IDEA of what I had even been accused of! I testified on the spot after the judge told me why, and he reinstated my Unrestricted permit the very next day.
Overall, it took me 4 months to get my guns returned to me, due to delays deliberately perpetrated by Wil Fowler of the Erie County PPO, and the Orchard Park PD. And as it turned out, when I demanded any and all paperwork from my local PD under FOIA (including the mysterious letter that Chief Mark Pacholec wrote To the PPO), Chief Pacholec refused to provide it to me. After I had learned of its' existance, and demanded a copy, he refused, claiming it was "personal", even though he wrote it in his official capacity, and on OPPD letterhead...
I eventually got it anyway through other means, and I got something else even more enlightening. I got a copy of a police report detailing that the OPPD violated the law when they disclosed the existence of my CCW to my ex wife a couple of days before she and the boyfriend showed up at my home and began screaming about my having a handgun and then calling 911. So, it really looks to me now as though those two deliberately tried to screw with me, and maybe get my permit revoked by creating an incident, and then crying wolf. And the OPPD criminally contributed to that (because I had already filed to prevent public disclosure of my permit) by the actions of Det. Lt. McMaster of the OPPD.
The bottom line for me was this:
1. Chief Pacholec didn't want me to have a permit in the first place. Why? Well, according to his own note to the PPO, which I now have a copy of, states that he felt that "because if I objected to the PPO taking longer than 6 months to process permits, I was likely to not follow the law if granted one, and therefore I should be denied one". That's really funny, because as I see it, he tried to prevent me from having one FOR COMPLAINING THAT THE PPO WAS NOT FOLLOWING THE LAW. And I have I have no criminal record either.
2. Chief Pacholec is a hypocrite. I learned that at the same time as he was recommending against me, - that some of his OPPD civilian dispatchers wanted their CCW permits. And when they learned that they too were looking at longer than 6 months to get theirs, the OPPD complained to the PPO! I guess they're more important than everyone else, and that they needed theirs sooner than ordinary citizens for their safety, - because they sit behind concrete block walls and bullet proof glass while in the presence of and surrounded by armed police officers...
3. Apparently it's OK for his Detective Lt. McMaster to break the law (NY Penal Law Section 400) and disclose the existence of my permit.
4. It seems that Chief Pacholec feels that NYS law doesn't apply to him and the OPPD, as he refused to acknowledge or release his letter when properly requested under FOIA, or stopping the actions of his Det. Lt either. Apparently, there are no consequences for running a police department that ignores the laws. Who knew.
The whole damn thing is just an example as to why "may issue" states can suck when small minded men like Chief Pacholec interject their prejudices. Instead of being against me for complaining about the PPO and their unlawful delays, Chief Pacholec should have stood up for me, and told the PPO to get their butts in gear, and follow the law.
And, it is an example of why, if you don't call 911 first, how you can end up holding the short straw.
