Denied my Sportsperson amendment!!!

My local PD Chief knows I got my guns back, because HIS own PD jerked me around for 3 months AFTER the Judge reinstated my permit! When my permit was initially suspended, I had to go to his PD and surrender my guns which they then stuck in their evidence locker. I was also pissed off when I surrendered them, because they make you sign a release form that says they have the right to dispose of them as they see fit (as in, they take them home for their own personal collections, or sell them and keep the money) if they remain in their possession longer than 1 year!
And when I stayed on their asses to get my guns back, they finally called me after 3 months (at 5PM) and said "if you can be here at 5:30 PM today, you can have them back". If I had been traveling that day, or maybe been 5 minutes late, they probably would have jerked me around even further. As it was, I made sure to get there 10 minutes early at 5:20. The officer walked out, saw me, and said "why are you here early, - I told you 5:30PM". I told him I sure wasn't going to give him an excuse by being late. He scowled and went back inside. At 5:30, he walked out, and handed me a bag with guns inside, and started leaving. I told him, "Um, no, - you inventoried them when I surrendered them, and now we will "uninventory" them. Get the list out, because we're going to check every make, model, and serial number, and I'm going to note the condition and take pictures of any damage". (I had taken pictures of every one of them BEFORE I surrendered them.)
I made damn sure I took my time too. Jerk me around for months, and expect me to meekly take unverified possession, and say thank you? Hell no!

Wanted to let everyone know the "Sportsperson" restriction is still alive in Westchester. I applied for my first ever permit in April 2019 and received my Sportsperson license in July 2019. Yes, it is not advertised on website or in the handbook. I filled out the "Generic Attachment" and stated my case.

Just curious as I have no skin in Westchester‘s game. What would they amend your license to if you took the 8 hr Security Guard’s course followed by the 47 hr Armed Security Guard’s course for employment on the weekends in a Per diem basis?

If you were legitimately employed (even per diem) as a security guard and your employer required you to be armed, you would apply for a Business Carry restriction in Westchester. In order to succeed you would need a letter from your employer indicating the need for you to carry a firearm during the conduct of your job responsibilities. The letter would have to indicate the days and times that you would be working and the Business Carry permit would be restricted to carry only during those times (as well as to and from your work activity).

If you have legitimately established a business (registered with the State, pay taxes etc...) that you own and operate and you are legitimately an employee of your own business (even if you are the sole employee), and you can establish that you work as a security guard, per diem, for yourself, then I guess you might have a chance. Remember, in NYS and especially in Westchester, it is the sole discretion of the licensing officer (in Westchester a judge) whether or not to issue a pistol permit and whether or not to impose administrative restrictions. The judges are not stupid. I think if you tried to claim that you worked for yourself as a security guard (no other business employs you for that purpose) regardless of any security guard courses you may have completed, the judge may turn a skeptical eye. Worth a shot I guess. As a may issue state, NY law has a provision that says a pistol permit MAY BE issued when PROPER CAUSE has been established. Its all a matter of if you establish that you have proper cause to the satisfaction of the licensing officer. Aside from a basic firearms class certification as required in some jurisdictions (Westchester for example), all the courses and classes you take in the world (range safety officer, firearm instructor, safe handling, personal defense, armed security guard etc...) do not trump the need to establish proper cause. Unfortunately, proper cause is in the eye of the licensing officer. This is extremely subjective without any established objective criteria. It is why challenging a proper cause determination in court is so challenging. Unless you are in a prohibited category, you will likely get a permit, but it will be significantly restricted the closer you get to NYC without satisfying a proper cause to carry unrestricted (or for business purposes).
