That’s not what is being said. And if so, they are so wrong . The argument among DAs as to if was binding was before the second circuit appeals court ruling and they were arguing if it was binding before such a ruling .The law is technically still on the books. NYS Penal Law 265.37 - Unlawful possession of certain ammunition feeding devices. That part of the law was struck down in federal court as an 'arbitrary restriction" that violated the Second Amendment. There has been some debate as to the applicability of the ruling. There is an opinion among several District Attorneys that the federal court opinion isn't binding until it is upheld by the Supreme Court. Most District Attorneys, however, are choosing not to prosecute.
