No. The case brought by Texas was critical and they took the easy way out. The case raises Constitutional issues that no other body can rule on. Compromised or not they have become part of the dismantling of our country.

Even if you get your fine refunded after spending $100k in legal expenses, that is not a win.

The government (and the agents in particular) need to be penalized when it/they violate your rights.

No more "OK, we'll give you the money back, no you don't even get an apology".

How about "your qualified immunity is gone, violating rights is not a legitimate government function, so when you did it you were operating outside the confines of your employment".

I'd like to see about 100 different class action suits against FUAC alone for that.

Well, that's what I say when they violate rights. They should have known better. If ignorance is no excuse for the masses, it's certainly no excuse for the government agents either.

It's real easy, they need to ask themselves "is this action going to violate someone's rights ?" If they can't say "nope, no way it will", then they don't do it. If that means a few bad guys get away, so be it.
