Is public transportation private property?

There is no law saying riders MUST wear one - only a suggestion.

The "official" isn't wearing one but he's ordering people off. Even if there was a law then he shouldn't be allowed on.

Looks like the cops just dragged him off and then walked away.

How do you get private property of the city, when the city isn't a private corporation? That makes it, by definition, public property and subject to the Constitution.

I get it. People are dying and people without symptoms are spreading it. I haven't been going anywhere but the grocery store and work. Most of us aren't because we're trying not to spread this around. I don't do it because I'm told to. I do it because I don't mind limiting my activities for a while to help. This whole lock down stuff is violating our rights but most people are on board with it(myself included) because we want this to end as soon as possible. But when you start dragging people off busses it goes way too far. I hope this guy makes a boat load off that department

Many transit systems have rules and regulations that are backed up by a state’s penal law subject to ejection, fine , or arrest. According to their Rules and regulations which are different everywhere, they may have the right to eject a passenger from the transit system. Here in NY they do.

I’m not sure the constitutionality of this but they are there and do it all the time here in NY.

But if the driver allowed him on and then changed his mind and the man had already paid the fare I don't see how the bus Co. can then choose to enforce the rules. I smell a law suit.

Agreed, shouldnt have been allowed on to behin with. Hard to tell from the article if he'd been on for a while and THEN they ordered him off, or if he had just hopped on at a stop and was told then, "no mask, no ride" .

SEPTA uses a card system that's just a tap and go, so he easily could have been on the bus and fare paid before a driver had a chance to stop him.

You pay a fare to ride the bus, it's not a free service provided by tax money, but it is subsidized. They're run by SEPTA, a regional transit authority. And SEPTA has a right to set policies on riding.

Not sure what the laws and the rules are to board these buses. I do know that in the Buffalo area, the Metro buses have lots of rules and regulations that need to be followed.

I think the rider should have not fought with the Police and I think the Police could have acted much better.

Lose, lose situation for all three entities involved.

Regarding the story, transit authorities have the authority to establish their own rules and they are enforceable. Here in NY depending on the particular railroad (there are many) you can’t play a radio in the train car, or you can only use the phone on a phone call in a particular car, or you can’t travel with an animal unless it’s a service animal, or you can’t board with no shirt, or you can’t board with an open container, etc.

Some railroads allow open containers. Some don’t. Some allow animals. Some don’t. I have seen people ejected from the train for violating the rules. Some get fines. Some only get an ejection.

Regardless, you can’t do whatever the fuck you want while on them just the same as you can’t do whatever the fuck your want in the DMV, a courtroom, town hall, etc. The police can physically eject you from any of those places for not following the rules.

My guess for the backpedaling in Philly is political correctness.

The fact it took ten of them and then they didn't even charge him with anything is ludicrous.

Also if it's just a guidance and not an actual rule/law, that is as well.

Now that said, if this transportation line can make up rules on the fly to dictate who can and can't ride their stuff--as I'm guessing they can--if you fail to follow a rule you need to assume you'll be removed. If you get on a bus and fail to pay a fare you'll also have the police called and asked to get off the bus. if you fail to do that you'll be dragged off, even though it was "over $2".

Last I looked DMV is closed completely.

Public business still has rules of use that need to be followed. That doesn't change simply because they run on tax money. It's real simple, if you want to ride the bus to travel, put on a mask. Otherwise find another mode of transport.

Stories like this run amok, but to be clear, he was not dragged off a bus for not wearing a mask. How do I know? because if get on the same bus without a mask nobody is even going to call the police. They will ask me to get off the bus. And if I do that nobody is the wiser for it. I'd bet my life he was asked first to get off the bus. He refused to do so.

What he really was dragged off the bus for was refusing to get off the bus. And was so incessant in his belief he should stay there that it took 10 police to convince him he was wrong.

I still think it's absurd that despite all this he was not charged, which does make the police position looks a bit crazy.
