I have always used the Third Amendment to explain why the Second Amendment IS the 2nd amendment. Quartering troops was a real hardship on the colonists and that is why it was numba 3.

Landlords are prevented from charging rent right now in a lot of places, even the 3rd isn't a stretch.

Definitely seems to qualify as a taking under the constitution IMO. The main purpose of a rental property is to collect rent. With the govt. dictating that the owner of said rental property cannot pursue legal means to collect said rent or regain control of the property to use it for it's primary use purpose I can absolutely see legal challenges coming. These should be open and shut cases.

There is a very blury line between full communism, and a government that technically allows you to "own" a property, but dictates exactly how you must use it.

Does it matter if they seize the property, if they tell you exactly who you have to rent it to, how much you can charge, etc... ?

It kinda sounds like you are just the property manager for a government owned rental property at that point.

We get the same thing in a lot of industries. They are so heavily regulated that there wouldn't be much difference if they *were* taken over by the government.

...especially since the government IS making money from the taxes on that property, and you lose the property if you don't pay the taxes.
