I believe he was given immunity hence no prosecution.
The fix was in from the beginning on the whole clinton investigation. Obama sent emails to her on that account and lied about it. The feds couldn't get clinton without also getting obama so the investigation was rigged. Andy McCarthy from National Review has written about this quite convincingly.
