Most likely. However, I believe that having all of the lower courts in multiple jurisdictions with extensive opinions like stayed will give the plaintiffs a stronger case to argue towards the Supreme Court. Especially when the circuit court doesn't give anything more a 2-3 sentence reason in response to 80+ pages (or int his case 240 pages) of reasoning from the lower court.In 3,2,1...Third Circuit Judicial court will reverse it..as usual...
I am really starting to believe we do have good judges out there, but the ones who follow the law are being overlooked for promotion.
