Rochester, N.Y. (WHAM) - Ahead of Charlie Tan's sentencing hearing next month, federal prosecutors are arguing that "the time for charade has passed" and call for him to admit killing his father.

Charlie Tan pleaded guilty in June to having another person purchase a shotgun with the intent of killing his father Jim Tan at their home in Pittsford in February 2015.

In a government sentencing memorandum filed Friday, Assistant U.S. Attorney Lisa Fletcher said regarding the home life of the Tan family that "there were a million ways to handle it. Pre-meditated murder was not one of them."

Sentencing guidelines would have a sentence of 25 years imposed based on the offenses.

But new details outlined in the memorandum also outline steps taken by the Tan family after Jim Tan was killed on February 5. According to prosecutors, the Tans drove overnight from Pittsford to Toronto.

Embattled Rochester City Court Judge Leticia Astacio has been indicted by a Monroe County grand jury on a weapons charge.

Astacio was indicted Tuesday on the charge of attempted criminal purchase or disposal of a weapon, a felony. She was arrested and charged in April after being accused of trying to purchase a shotgun at Dick's Sporting Goods in Henrietta.

The arrest stems from an incident on April 2. Seneca County District Attorney Barry Porsch is prosecuting the case.

Astacio remains on probation for her drunken driving conviction and has not been hearing cases since her February 2016 arrest. The terms of Astacio's probation prohibit her from "possessing a firearm, dangerous weapon, or noxious substance."

It's the same charge as her earlier charge, but a grand jury ruled that there is sufficient evidence to proceed with the criminal case.

On Friday, attorneys for the office of the U.S. Attorney in the Northern District of New York submitted a sentencing memorandum asking that Tan be sentenced to 25 years in prison. In June, Tan pleaded guilty to three federal weapons violations for illegally getting a friend to buy the shotgun

Charlie Tan admitted that he coerced his friends and classmates to buy him a shotgun and lie about it so he could commit a felony.

He did not admit to murder even though the murder of Charlie's father, Jim Tan, was spelled out in the prosecution court papers.


In fact, in court the assistant U.S attorney said she was going to prove Charlie Tan committed the murder.
James Nobles, defense attorney: "Well it's not a court document. It's a document filed by the prosecution and as you heard, we didn't agree with it."

Brean: "So Charlie did not admit to the murder at all, did I hear that right?

Nobles: "That's absolutely correct. What we did today ( Friday) was we plead guilty to the elements of the crime that he's charged with which obtaining a gun with the intent to commit a felony at that time. That's what he plead guilty to today, nothing more, nothing less."

he didn't have a title on his name .. like Judge and so on .. could have been the locals too and not the Feds ..
