Because the State doesn't want to risk setting a precedence, risk or incur the cost of Trial, or lock up their number one source of fear mongering.
Seize the gun, ammo, money, and Drugs, take their prints and pictures turn 'em loose with an appearance ticket then plea-bargain it down to a fine that'll never be paid and a couple months at the most in County lock-up....happens every fucking day just like that.
