Firearms Sales Rules?

One of your rules to sell a firearm via this site is:

All firearms must be shipped to and from an FFL

That has me wondering, is that a requirement of this site because it certainly is not federal law nor is it state law in NY state. I have written correspondence from the NY State police confirming that you do not have to ship handguns from an FFL but only to an FFL for a sale to someone in or outside of this state (and if shipping instead of a FTF sale) in order to comply with disposing of a firearm. Please note, and this is very important to understand when discussing 'firearms' under the NYS penal code, the definition of firearm essentially means a handgun and now also an assault rifle or a shotgun or rifle with shortened barrel. Rifles and shotguns that are not assault rifles and that have not had the barrels shortened below federal requirements are not considered firearms under the definitions of the NY State penal code.

So, just wondering if that is a requirement for sale specific to this site.

Also wondering, are you saying that FTF private sales, that require only a NICS check, are not allowed to be advertised in the forum?

It was my understanding that long guns do not have to be shipped from FFL to FFL when going out of state.

Handguns however must as per Federal Law if I'm not mistaken.

Follow all laws

You don't have to ship FFL to FFL if it's a private sale, or if it's going out of state (unless the receiving FFL requires it).

I just did some searches and it does appear you can indeed ship a sold handgun to the buyers FFL.

Most FFL's in NYS (at least here on LI) will not accept a gun shipped from anyone other than an FFL.
