What ATF told us was to sell and deliver the Lower first as it's an "Other" after that point it can be returned, any work performed amounts to "Gunsmithing".
Admittedly it's easy and somewhat stupid that a Dealer can order in a complete lower receiver, but when HE mates them it's now "Manufacturing"
I get it, a specific Licenses is required, and excise taxes paid (which originally were optional to the manufacturer) which is ATF's only reason for perusing this.
Back before the popularity skyrocketed (think the AW Ban of 1994) many manufacturers, wholesalers, and Distributors would admonish FFL's not to order any Upper or kit and include the stripped lower with it, in fact many would not place the two in the same shipment or invoice to avoid possible impropriety of manufacturing without an 07 FFL.
Wonder if the "employee" was an Agency plant or what they threatened him with unless he rolled over?... there is ALWAYS much more than what the Press is allowed or privy to.

What is the difference between manufacturing and just assembling parts? It would seem to me that manufacturing would be machining new parts from a block of metal. He is just assembling already manufactured parts. This is a bunch of BS.
There is no historical analog to banning the private manufacture of firearms.
There weren't always big-box companies making the guns our forefather's used. Some made their muskets themselves.
Whether I want to "assemble parts" or "mill a block of aluminum", it is my Right. If I want to bore out the center of a huge log, wrap it in steel banding, and pour a little gunpowder down the hole, that's MY RIGHT.

is there a difference in the almighty atf about assembly vs manufacture as if he bought parts and assembled the kits and sold does equal manufacturing vs assembly..........
unless he was doing it from lower 80% kits or something....but if bought the lowers and uppers as an FFL and just assembled them for sale as full its....but im sure there is something that says they are still "manufacturing" them.....or something like that?!

Manufacturing should just be "starting with a pile of something that isn't a gun, and ending up with something that is".
Only the ATF could come up with the bizarre notion that someone manufactured a gun out of a gun.
