Form to remove pistol off permit necessary?

So I sold a couple of my handguns and normally I go to The Firing Pin to get them shipped and they give me a removal form with make, model, serial etc. that I bring to the county clerk in Livingston when I eventually have it removed. The county clerk has never asked for the form, but I always provide it because I have it.

Anyhow, since The Firing Pin got shut down I ended up going to Allstar Tactical. I was eager to get out of there and doing multiple transactions and ended up forgetting to get a removal form for a pistol. In fact, last time I shipped a pistol through them I had to ask for a form and the kid working there obliged but told me it wasn’t needed.

My question is, when the clerks open back up, will they remove the pistol from my list without a form? Has anyone done this before? The pistol is out of my possession and has presumably been shipped by now.

All they gave me was a paper receipt stating the total cost and on it it says “shipping“ two different times (I sold a rifle and a pistol and needed them both sent). There’s nothing specific.

The Livingston County clerk is pretty good. I've never sold or transferred a pistol, so I don't have first hand experience, but based on previous dealings with them I would assume you just need to let them know which one to remove.

I could probably call Allstar tomorrow or Monday but they didn’t seem like they were in a good mood (or maybe they just don’t like me!) and I would think the burden to provide any form of receipt would be on them. If it ends up being an issue I’m sure they must have the transaction documented. With the number of people shuffling in and out of gun stores right now I’d prefer not to go back.

You need a bill of sale to remove a pistol from your permit. It has to have the dealers FFL and NYS dealers license numbers ,along with the name and address of said FFL. on the receipt. The MONROE COUNTY CLERK will NOT remove a pistol with out this info.

It’s all good, I called Allstar and they were very helpful, informed me that they could get me a removal receipt at any time in the future as they have it all documented. Probably will just wait until clerk is back open.

So in effect, it is not your personal property and the owner wants to know what you're doing with his gun.

In general in NYS you must file an amendment with your issuing authority (Sheriff, county clerk, etc.) to remove the firearm from your license when disposing of or relinquishing said firearm. Counties have different methods and require different documentation, but each must include the FFL who did the transfer. This is OUR duty, because each issuing authority eventually reports these changes to the NYS Police; THE keeper of all NYS firearm records. If you don't remove the firearm, and in turn it is reported as involved in a crime, lost, stolen, recovered, etc. YOU on on the hook. The easiest way to get caught up in this quagmire and get your ass in a sling is when the new owner files an amendment to ADD it to his/her license, and it still shows it as YOURS in their records! As with all twisted, f'd up rules in NYS what they do about it depends on each respective issuing authority or NYS Police.

Also, thanks for the reminder. I sold my Shield a while ago, and then all this shit hit, so I still have the receipt from the transfer at the gunshop in my truck. Any idea if there's a length of time that this needs to be done in?

It might differ by county, but in Oneida County you're supposed to report a sale/transfer of handgun within 30 days*, though with the current WuFlu business they've extended it to August (mainly because they're not letting anyone do amendments until 6/22...).

* - I once waited almost 2 months to report a sale, because fuck taking half a day off work and driving 30+ minutes to the Permit Office just to do that. They never said anything but if they did I'd just "I couldn't get time off work" which is sometimes true..
