The ATF turned it over to the NYSP because the violations of law were violations of NYS law I assume. As the case develops, I guess we'll find out. The ATF did take action by pulling his FFL.
So, by your evaluation 2 wrongs make a right. If your assessment held any sway EVERY manufacturer would flood the NY market with fully featured MSR's and EVERY licensed retailer would be offering them for sale. Ever notice that NO manufacturer or retailer subscribes to that practice ?
Same goes for standard capacity magazines....and untaxed cigarettes.
...and by "the train" I refer completely and fully to JGS and the case against its owner and employees NOT the 2nd Amendment. My comparison of selling alleged (notice I keep including that VERY important word...alleged) MSR's to selling uninspected cars is only to illustrate that laws exist, even laws we don't like or question their constitutionality, but unless and until a Court of competent jurisdiction deems them invalid, they're STILL valid. If not for the Civil Rights Act and similar legislation, Blacks would still be using the "black only restrooms" you spoke of. Again...laws are important, they have meaning, and they have consequences.
You and I do agree on one thing...Dave Jenkins referral to MSR's from a shooting sports perspective only tells a small portion of the story.
I've said all I have to say on the matter. If one can separate the "activism" from the facts of the case, it's easy to see JGS is NO sacrificial lamb for the cause . In my lifetime, I've never met anyone willing to risk spending significant time behind bars and lose all they have worked for (business, family, person possessions, reputation) unless they were enticed by ....profit.
