I told him the law stated that the Background Check shall "verify that everything stated on the application was true", yet the Deputy showed up at my door, asked me a few questions, and then asked me to pick out a neighbor that he could interview about me.

I asked Howard to show me in the law where that is acceptable. I got to hand it to him. that practice was stopped. Under Howard the wait time did improve, I waited 18 months in Erie County. He promised to fix it. Maybe now he will. Or not.

Pistol permits only sped up in sheriff's investigation jurisdiction. If your town had a police force then they could sit on it for months (West Seneca, Amherst, City of Buffalo, Orchard Park....) My jurisdiction is sheriff and they processed my wife (3 years ago) quickly. Wife is a reference for a number of (wimmins) applicants and sheriff has been following up with interviews weeks after application. There seems to be a good working relationship between PP office and sheriff's office. Current judge is very pro 2A that helps too. PP office has made nice improvements the past 5 years.

One of the points he made was to allow all backgrounds to be completed by the Sheriff's office but that would require permission from the individual local PD's. They used it as fill-in work or for guys on Light-Duty recovering from an injury. You are right. it varied by jurisdiction both on the time and the breadth of the so-called Background Check.
This is what Article 400 aka the Sullivan / SAFE Act says about the "investigation" that was taking over a year to complete.

4. Investigation. Before a license is issued or renewed, there shall be an investigation of all statements required in the application by the
duly constituted police authorities of the locality where such application is made, including but not limited to such records as may be
accessible to the division of state police or division of criminal justice services pursuant to section 400.02 of this article.

My point was: there shall be an investigation of all statements required in the application. That is the law. That means nothing more and nothing less is allowed under the law. So when the Deputy took it upon himself to interject my neighbor who was not listed on the application, he was overstepping his authority and the law.
Section 15 says:
15. Any violation by any person of any provision of this section is a class A misdemeanor. Wasn't the Deputiy a "any person of any provision" You bet chroass he was.
Speaking of other "any person of any provision of this section" Read this:

Upon completion of the investigation, the police authority shall report the results to the licensing officer without unnecessary delay.

Now we are talking about the Police in the Citys and towns.
I used to be pretty passionate about all of this having moved here from Missouri. I was shocked and pissed off that the Second Amendment could be bastardized and nobody in New York Second Amendment Advocate Community gave a shit.
They to a man had the attitude that I got mine and it is for life. How did that work out for them?

Now I don't give a shit anymore. I got mine and I have to re-certify it every five years.

Here is another example of "any person of any provision of this section" committing a class A misdeameanor.

4-a. Processing of license applications. Applications for licenses shall be accepted for processing by the licensing officer at the time of
presentment. Except upon written notice to the applicant specifically stating the reasons for any delay, in each case the licensing officer shall act upon any application for a license pursuant to this section within six months of the date of presentment of such an application to the appropriate authority.

Such delay may only be for good cause and with respect to the applicant. In acting upon an application, the
licensing officer shall either deny the application for reasons specifically and concisely stated in writing or grant the application
and issue the license applied for.

Read that last sentence again
or grant the application and issue the license applied for.


But the laws are for you and me, not for them.

Isn't this a "golden parachute" He will get his county pension and another county paycheck counting toward another pension?
