Southeast Special Response Team Officer Dillon Biggs and Officer Sukhbir Chauhan were proactively patrolling the area of Third St and Madison Ave in an effort to reduce gang violence and shootings in the Southeast Policing District. They initiated a traffic stop for a vehicle code violation. They contacted the driver, 19 year-old Amador Carlos Martinez, a self-admitted Ruthless Thug Life Fresno Bulldog Criminal Street Gang Member. Martinez admitted to Officer Biggs he had a loaded 44 Magnum revolver under the driver seat."

Boy. Your statement has so much fail. If they can be charged against the 2A for having a black powder revolver, we can. There is no disputing that.

Furthermore, at the point of contact, the gang banger was committing no crime other than a traffic infraction. His past or future crimes do not come into play at the traffic stop. I know you don't like this but it's criminal prejudice. The same can be done for someone with a 3 percent sticker on his car. You either committed a crime or you didn't. Everyone has rights not just some.

Had he had a Gerber pocket knife, there would be no crime to charge home with. The revolver should be the same as the Gerber knife unless you would look for a way to charge him for a Gerber knife just because he's a gang member.

I agree with the idea that a simple traffic infraction isn’t enough probable cause for a vehicle search.

It may have been that he was in possession of an unlicensed firearm - a crime in California. If it was loaded in the vehicle that’s probably another crime.
There’s the criminal behavior.

It would be interesting to know what lead to the discovery of the gun in the first place though.

In the Founders day, they were sometimes killed outright within minutes of conviction by kangaroo courts (I’m actually fine with that too, mostly). Nowadays, the people who’ve lost their gun rights have been throughly afforded all legal protections prior to that happening. So it stands as a principle and is not an infringement on the 2nd Amendment. Shitbags don’t enjoy the same rights as us.

Shitbag criminals should be locked up. Penalties for the major crimes like robbery, rape, murder, larceny, ect should be severe. If they're free they should have the same rights as anybody else unless they are released on probation. Probation can be any length of time given based on the crime they committed.

Our system is broken can any cop or DA that wants to charge criminals with crimes that shouldn't be crimes are part of the problem. Lock them up for what they actually did and make the punishment severe without plea bargains rather than releasing them early and then using charges that validate an unconstitutional law to put them back in.
