Having an illegal gun doesn't mean you cant use it under certain circumstances. You don't lose the right to self defense just because you don't legally possess a gun. You can still use it to defend yourself or others. The gun charge is a completely separate matter. You were still justified in using it.

Actually it’s a violent felony so there is no way to get your firearms rights back and the second article said he’s a felon so he can not possess a gun. Some felonies you can get expunged for legal reasons, but not ever own a gun if they are violent felonies. I k ow a guy who’s going through this now since he was drunk driving and killed a girl. It was 40 years ago and he wants him pistol permit. Lawyer says he thinks it’s a go.

Sure, but he plead guilty to manslaughter and says he was guilty/bad choice to this day. I’m guessing he was involved in illegal activities at the time. He was also arrested for domestic violence and selling crack. So really he could have three felony arrests. I don’t really care to dig into it more to find the circumstances surrounding it.
I get he took legal means to get his record cleaned up, but he admitted he was a felon and people still elected him that’s my concern. The reason why you take those legal means is so it doesn’t show up to employers from what I understand, but this moron just admitted it. I wouldn’t have voted for him.

You can’t, but he took steps to get this scrubbed off his record and was successful so it doesn’t show up on a search of an employer. My concern and problem is this guy admitted it so I am questioning if this is allowed. I know his steps legally make it like this never happened, but I just don’t know what the law says.

Like I said. He can’t. But thank you for the education opportunity back into this area of law. I had case years ago about this before they changed the law that barred violent felonies. He can’t get the right to carry a handgun that way but there are ways.
They did it with the retroactive punishment of domestic violence for people who plead guilty before the Lautenberg admendment took away their gun rights retroactively. Guys would plead guilty before that because it was a violation or a misdemeanor and it was easier and cheaper to accept time served than fight it. They would have to go to court to get the conviction overturned and the record expunged. It was the same with felonies for some.

People can change. Look at Tim Allen, the comedian of the show “ Home Improvement “. He did fed time for drug dealing .

But 17 years olds usually get two to three chances before they get a record and 16 was the age of criminal responsibility. If he was under 16, his juvie record is sealed as if it didn’t exist. If arrested at 16 to 19, they get Juv offender status in most cases. The record is sealed even when they are on probation for the next offense, then when they are arrested for the third time, they are treated as a first time offender. So he might have committed more crimes and been caught more than he is saying
