I do not like this. I do not like it all.

However....

In explaining that I do not like this, does not take away that this is in fact law and has been for a very long time. Many, if not all Veterans were made aware of this when they opted into the program for the payouts. They do not take all of the Disability monies at once, it is prorated over a long period of time.

It is nearly the same if once bought out of Active duty, one joins the Reserves or Guard and qualify later in life for retirement.

It is a law but since someone was injured as a veteran and now disabled doesn’t mean they shouldn’t get the same separation pay as a guy who was not injured and is now disabled. Its a way for .gov to minimize their losses.

I agree. It is shitty. I just pointed out that it is the law and most vets are made aware when they take the buy out.

President Bush, younger did Vets a solid, he altered the law so vets receiving disability can collect their retirement as well.

There is also a stimulation for a reservist that is called to Active duty, all disability payments stop during the deployment.

Lots of very odd rules, like I said, most are aware of these weird laws and rules.

There really needs to be a statute of limitations on this type of thing. Bad debts expire after s period of time. Coming after the guy 32 years later is far too late IMO.

So can they just garnish his payouts then? Its hard to tell from the article. Its be kind of double jeopardy for the VA to withhold his income until he pays back the $30k. Kinda like the bank charging you an overdraft fee when you OBVIOUSLY have no money.

The article says they can because a law about separation pay and disable vets not being eligible for it. It makes no sense to me and if you were working at the time of separation you should get both. Isn’t that discrimination based on a disability?

It could be. Probably not though, the service member is made aware of this prior to taking the buyout.

At the time, the buy outs were not mandatory.

When Bush Jr. altered the regs to allow retirement pay and disability pay to be paid, he tried to have this altered as well. Congress said no. Nor sure why, so few are affected by this.
