All these so called gun buy backs,aren,t these the same as allowing a straw purchase of your gun?Who the hell is doing a background check and who the hell is that gun being specificlly transfered to? If you were to allow a (buyback) of a gun that you legally purchased after the Safe Act and did proper paperwork and background check how does one explain where and to exactly did it go??? If these guns are destroyed isn,t that illegal??

My paranoid friend, of legal age and with a clean record ( not a prohibited person) asks me to buy a shotgun for him so he won't be on a government list.

If I bought the shotgun for him, not as a gift but for the purpose of him avoiding the background check, it would be a straw purchase even though he isn't a prohibited person and could pass a 4473/NICS check.

Wouldn't be a straw purchase anyway. It is not a purchase by an individual, but a corporation (governments are corporations) that intends to destroy it, not transfer it.

In order to be a straw purchase it must have been purchased with the intent to transfer it to another entity.

But you are correct, even if the end owner is legally allowed to purchase it themselves, they have to be the one the BGC is run on.

There was a case a while ago where a cop bought a gun for his buddy in order to use his LE discount. The buddy was perfectly capable of buying it legally himself, but at a higher price.

The cop was convicted of a straw purchase.

No, the dealer obeyed the law and wasn't going to do anything to jeopardize his business. By the way, even if you pass a NICS check, the dealer is not obligated to sell it to you if he suspects something is not right. That is left up to any dealers discretion.

When you buy the gun one person does NICS check and gets the needed receipt then 2,3 or whatever people go to the county clerk and co-register it. One background check for the actual buyer. County clerk handles the rest.
When the NICS check is done online or on the phone the serial number is not asked for.
