Anything anybody does with their property, you can guarantee that Suffolk County PD will be asking for documentation to prove it.

And if you have a pistol permit be prepared for them to threaten suspension, and demand you turn in your hand guns to them. Keep in mind if this happens you should legally be able to turn them over to an f f l the hold onto for you.

They can ask for whatever they want, outside of a lawful order, it's just a request!

Any arduous, arbitrary and capricious action thereafter is nothing more than malicious prosecution and a distinct and serious violation of your rights!

If you don't possess the items they're looking for, they can't confiscate anything! FFL or not... And what documentation would be acceptable? Some law enforcement letter from a foreign jurisdiction notifying the local LE that they executed a warrantless search on their behalf and made note of the presence of said firearm in question?

They will apply whatever pressure they can, and want to... In order to avoid the inside of a courtroom because everything changes there! They don't have the luxury then to effectuate anything outside what the law prescribes! And the judge could do whatever they want as well, but the fact that it's all memorialized and is on record puts them in a bind as well to "follow" the law... We all know some like to legislate from the bench, but that never ends well either!

So if Suffolk County wants to chisel this into stone, let them... The question is whether or not you'll co-operate and comply. It's ok either way, it's just a personal choice! For those in Suffolk, have fun!

Everyone who got that letter has been given a gift.
Comply, or not, with that letter as you see fit.
And then file a criminal complaint against those who wrote the letter.
You've got them dead to rights. FFS USE IT.

It is absolutely reasonable to expect that you'll be flash-banged if you did not comply. THEY SAID AS MUCH.
It is absolutely reasonable to expect that your property (the weapon) will be damaged or destroyed by these people.

Over an item that they know to be perfectly legal in NYS.

Make THEM spend the next 50 years fighting to get THEIR freedoms back. Every one of those letters is a felony.

If a postal inspector is 2A sympathetic, that might even be a more interesting tactic to look at, since they sent this false claim by federal mail. That crap would be resolved in Federal court, not local or county.

7. Testify or provide information or withhold testimony or information with respect to another's legal claim or defense; or

8. Use or abuse his or her position as a public servant by performing some act within or related to his or her official duties, or by failing or refusing to perform an official duty, in such manner as to affect some person adversely; or

9. Perform any other act which would not in itself materially benefit the actor but which is calculated to harm another person materially with respect to his or her health, safety, business, calling, career, financial condition, reputation or personal relationships.

How is it confiscation? He shouldn't have had it to begin with. Somehow it slipped through the cracks, and wasn't his fault, which is why he's. not facing charges. Now if you want to discuss unjust laws, that's another topic. Nothing wrong here and no need for buzz words and. getting people excited that won't read the letter or are unable to comprehend it.

The Accreditation is something that many departments try to get through the State. Once the department gets this, they put it on everything.

I was just trying to make a reference or joke that it is ironic they are supposed to uphold the law which I thought had something to do with the constitution and not harassing an individual over a firearm that seems to be totally legal. I feel bad for these guys in Suffolk. From what I have read on the Reddit page it seems like their is an attorney willing to work with all the gun owners targeted. The good news in all of this is that the court will finally take up a case on “others”. In my opinion I think there is a good chance this can be a 2A victory. CT, NJ and CA all have ruled that “others” were legal. I may be overly optimistic, but I’m hoping the DA from Suffolk loses the case and we put this thing in to rest

What we don’t need to have happen is for either the Suffolk DA to drop this so it doesn’t end up in court or for everyone to surrender without a fight and it doesn’t end up in court. I think the last thing NYS wants is for this to end up in court and for a court to decide said firearms are legal. I say pursue legal action and call their bluff.
