These companies only need to stop selling in NY for a short while. 2 weeks or a month, and the effect will be devastating. Between public outcry over lack of energy, and hole in the budget from lack of sales taxes, maybe some eyes will get opened.

It's a given that the New York State legislator can levy taxes and fees.
But I always thought that it was the judicial branch that levied fines.
Am I wrong about that? If I am it would be nice if someone chimes in and lets me know.
I've always thought that to be fined one had to be proven guilty or an admission of violating a law(s) in a court.
I'm going to have to re-read the article, I must be missing something because using the knowledge I currently have this isn't making any sense.

I believe this is a suit, not a fine. It will be in courts for years (well past the Gov race) and only the lawyers will benefit financially. I wonder if the Queen can identify anything within arms reach not made of or petroleum products.

Even *if* it's found to be a valid law, the constitution explicityly bans ex-post-facto laws,
so you can't fine people for things done before the law was passed.
I would love to see every one of these companies just stop doing business in NY because suddenly their business model is now illegal.
