Homeowner Arrested After Shooting Burglars With Illegal Gun

While I don't take anything a prosecutor says at face value, it looks like there is good news/bad news for this guy:

"The problem is, he does not want to be released at this point, because he doesn't have a home, his home was condemned," said McNamara, adding that Stolarczyk is also being treated for a potentially fatal leg infection.

McNamara points out that Stolarczyk didn't buy the gun illegally on the street in order to commit a crime with it; he failed to get a gun license and register his father's gun once his father died.

"No prior issues with him, no prior criminal behavior, he's a law abiding citizen minding his own business and put into a situation where he's forced to defend himself. This isn't the kind of guy that we're going to send to jail. I'm not even sure he'll end up with a criminal conviction on this," said McNamara.

So the DA is already saying he doesn't want him to do any jail time, and certainly doesn't sound like he's going to pursue the felony. Which is funny because the guy is in jail and has been since the start, but the way the DA makes it sound he wants to stay there for now because he's getting his leg treated and he can't go back to his condemned home due to the health department or whatever.

So hopefully this guy can use some of the $10K or what that's been donated to his case to get his sad life together rather than blowing it all on legal fees.

The worst part is the instructors were all cops.

I hate when those on the job think, feel and believe they are experts on guns and laws because they belong to a department.

They shouldn’t be teaching those classes then. They problem are “experts” on the handful of of laws most cops encounter regularly but don’t know shit about the majority of the remainder.

These Experts go far beyond those who work in LE. These military guys that grow their beards, get lots of tattoos and dress in really tactical looking cloths are doing more harm than good in the teachings of many of their classes.

I have met a few, seems they do not know their ass from a hole in the ground.

Some of the best advice I could ever give? Study these laws that will protect you if bad guys are doing bad guy stuff to you, and talk to an attorney that specializes in these types of laws.

The cops are probably the best source of information about what is likely to get you arrested, since that is what they do.

Probably not so good about what will get you convicted though. Although an arrest even without a conviction can get very expensive and cause all sorts of other complications.

At the end of the day avoiding the arrest is best, but don't risk getting dead because of that. You can say the same thing about conviction, but obviously the risk/reward relationship is a bit different for conviction vs arrest.

Ultimately the guys who are experts on the tactical situation are probably not experts on the legal ones, and vice versa. Getting legal advice from your tactical instructor is about as good as getting advice on the use of movement and cover from your lawyer.

My area has several properties that should be condemned, but local government does absolutely nothing. I think there is a rural mentality involved, and I don't mean that in a negative way. It's just a distrust thing. I do wonder how people can live that way, shit everywhere....

I'm an exterminator, you have no idea. Before that ive worked for the phone company. Ive been in many houses and have seen crazy hoards. Ive seen people living with rats and roaches crawling on them because they were scared of somone forcing them to throw thier stuff away. Kinda sad.
