While I don't take anything a prosecutor says at face value, it looks like there is good news/bad news for this guy:

So hopefully this guy can use some of the $10K or what that's been donated to his case to get his sad life together rather than blowing it all on legal fees.

So the DA is already saying he doesn't want him to do any jail time, and certainly doesn't sound like he's going to pursue the felony. Which is funny because the guy is in jail and has been since the start, but the way the DA makes it sound he wants to stay there for now because he's getting his leg treated and he can't go back to his condemned home due to the health department or whatever."The problem is, he does not want to be released at this point, because he doesn't have a home, his home was condemned," said McNamara, adding that Stolarczyk is also being treated for a potentially fatal leg infection.
McNamara points out that Stolarczyk didn't buy the gun illegally on the street in order to commit a crime with it; he failed to get a gun license and register his father's gun once his father died.
"No prior issues with him, no prior criminal behavior, he's a law abiding citizen minding his own business and put into a situation where he's forced to defend himself. This isn't the kind of guy that we're going to send to jail. I'm not even sure he'll end up with a criminal conviction on this," said McNamara.
