Interesting Phone conversation about address change...

Having just completed my home sale in NY. I was going to send in the form for the address change. So I called the county clerk just to inquire as to the process. Was instructed to fill out the form and was also mention to check the "surrender" box...

???

I told the clerk I was not surrendering as I still have family and business in NY which has me visiting a few times per year. The clerk replied, well, don't check the box, provide a brief explanation and let's see how the Judge handles that.

Like what?

I understand the clerk may not be aware of the Bartlett decision, but I'm also sure I'm not the only county resident that has moved away from NY and changed their address.

So...

What say you all?

I plan to fill out the amendment with my old and new out of state address, should I attach notation on the Bartlett? Or just see what happens? I prefer the path of least resistance, and honestly not sure if I'd ever bring my firearms back to NY, just in case.

Just do the address change and let it fly. You can address any other issues at a later date if they come up. The Judge should be aware of the current laws without being reminded.

Even before the recent-ish court decision, many non-residents had licenses by following the method. The law did not prohibit non-residents from possessing a license, it prohibited non-residents from applying for a license. And the only thing the law said about a resident moving was that they needed to notify the superintendent of the state police of their new address within 10 days. Not the county, not the clerk, not the sheriff. No language about moving within vs out of the state.

So, the process to get a non-resident permit was as follows:
- Be a resident
- Secure a permit
- Move out of state
- Notify the state police of your new address

...and many people did so, as evidenced by the many, many, MANY people in the pistol permit database with out-of-state addresses.

(Of note, there was also some wiggle room on the definition of "resident" in relation to applying for a license that some were able to squeak through on, prior to the recent-ish decision. Basically, if you owned land or primarily worked within the state. I think there were 1 or 2 other ways defined by law as well).

I agree send in the address update form. Many have done it. My guess is they wanted you to check the surrender box without question and many do.

The pistol clerk called me after receiving my change of address, asking about the surrender portion(4 years ago). I let them know I still have real estate interests in NY, They agreed that was ok. I filed the form with the NYSP twice, still haven’t received a reply or a “certification “ not that I care.
