In effect, we are increasingly governed not by the House and Senate but by partisan judges who rule on partisan lawsuits.

YES. I've been saying this on this forum for a long time now. We gave up one king, and gained nine kings in the supreme court. If everything is taken to court, it's the judges that have the power to let what they will slip through or not.

The biggest mistake the founders made, was putting the ultimate authority in the hands of judges. Put the power back in the hands of the legislature and the hands of the people, and abolish courts that hold that degree of power. If there is anything unclear, we should make the legislature clarify and expand the law. End. Of. Story.
