Interpretation of the law ( carry conceal)

Thank you for taking a look at my thread.

Before I pay $150 to speak with an expert for 30 minutes, I wanted to get input from this forum.

Regarding the SCOTUS decision and NY’s law being struck down, my understanding is that a New Yorker with a home permit for their pistol can now carry that pistol concealed anywhere in NYC, except in designated gun-free zones, without needing a CCW.

Some people have told me that this interpretation is logical but might need to be tested in court, meaning I could potentially be arrested first, which I am certainly not inclined to do. Obviously, the NYPD's website is still grossly outdated regarding the new regulations.

Does this seem like a reasonable interpretation?

I'm sure no expert on the carry laws, they change with the wind. I expect that's by design though.

The law clearly states you MUST have the 18 hours of "training" to carry a handgun concealed in NYS.
This is pretty clear everywhere I look.....so it MIGHT be correct.
Here it is from NYS, but the NYSP and my county site say the exact same thing. The only real change in the carry law is that you dont need to have a reason you want to carry......and the fact that its MUCH more difficult to get a carry permit now.

You need a permit to possess a pistol anywhere in NYS and after you get that permit to carry or posses a pistol in nyc you need a special permit if you live outside of nyc.
If I’m trading correctly you have a premise permit and think that allows you to concealed carry outside your home in NYS/nyc and that’s wrong as well.

Carry concealed with just a premises permit is not allowed. Just apply for an amendment and take the stupid 18-hour course. Hopefully, that course will be eliminated but doubtful.

Pay the 150 and talk to an actual person that knows the laws. Also, I believe that you can not conceal carry through out the state with just a premise/home permit, as that is only good on your premise( property) I could be wrong, Again, my 2 cents, pay the 150 and ask someone.

It does depend on the County and judge. Some will add CC to an existing permit. Some are requiring the training.

Ah, they won’t till you ask for the amendment. In NYS, there are several levels of permit. Only one grants Conceal Carry

Let alone a newbie, no introduction, just join and ask a completely ridiculous question? Can I break the law legally, what's legal if it's legal, how can I do it, etc.

Ummmmmm, do yourself a favor, go spend that $150 because it will probably be the best $ you spent before buying some ammo!

So NY is a "Shall issue" state and unless something has changed, there are two types of permits. Premise and Carry. In NY, unlike many states, the gun gets permitted, the user permitted to posses it. A premise permit is exactly that. The gun is licensed to be on the premise with some minor exemptions for range use and the process of carrying it to and from the range. The Carry permit is just that. The ability to carry concealed the gun in NYS not NYC.

NYC creates its own firearms laws separate from NYS. To my knowledge NYC has rarely allowed a "non-connected to city" person, a full carry permit. They lean heavily of conditions for carry such as business, employment and such but never 24/7 carry.

So with NYS being forced by SCOTUS to issue permits solely based on the two types in current state law, NYS makes it a requirement to take a CCW class. Everyone, regardless of type of current carry condition must take the class. Which is basically a straight up safety class and a couple of hours on Article 35, which everyone should be thoroughly familiar with.

NYS Premise permits can still be obtained without the CCW class and a simply safety class required for that permit for new applicants.

Now NYC is a different animal. I can't see them taking a NYS premise permit and allowing it, without an amendment, to be considered a carry license. I'm sure many residents opted for the restricted carry permit and so maybe NYC, to save time since their permitting offices are grossly under staffed, are considering just allowing it. After all, they don't abide by NYS law 90% of the time. Possession of knives are outlawed in NYC but not in NYS. I'm sure NYC will consider the 18 hour course but may not require reissue of an already restricted license since no restrictions were even legal to begin with. I just read they will allow non-residence CCW's from other states, while NYS will not.

I would consult a NYC firearms attorney and expect monthly changes to whatever they say.
