Iowa Police Chief Arrested"Exploiting his position as chief of police"( ATF /Machine Gun)

"Brad Wendt is charged with exploiting his position as chief of police to unlawfully obtain and sell guns for his own personal profit," Eugene Kowel, a senior FBI agent based in Omaha, said in a statement. "The FBI is committed to working with our law enforcement partners to investigate and hold accountable those who violate their oath of office to enrich themselves."

What is the actual charge here? I bet he walks unless they can prove he stole department money or property. Maybe they will nail him for not dotting an 'I' on some form. The only difference between this and what politicians do, is this directly involved machine guns.

Maybe I'm missing something though.

I guess I don't understand this. He obviously had a SOT to be able to handle NFA items, why did he have to go through the dept to buy them? Were these NFA items being purchased directly from the government? The article alludes they were all post sample, so how was he able to make "significant profit"? They are really not worth anything as the only people that can have them are government entities and SOT's.

Post 86 machineguns for a *dealer* can only be obtained if you have a "law enforcement demo letter".

Basically an NFA dealer can only order post 86 machineguns if they have a letter from law enforcement suggesting they will have a legal buyer.

They can't just order a few for "inventory".

If you have a manufacturer license that doesn't apply, you can order them for "research" without a law enforcement letter.


So, the moral of the story is get the type 7 not the type 1 if you want to play in the machinegun world.

The department probably lost money on the deal. Everything else was legal.

Uh, NO town or city has a need for any machine guns. I heard once that 'assault weapons' were designed to kill as many people as possible.

Two possibilities. First is that an FFL requires a letter from a PD requesting a demonstration of a machinegun in order to purchase one. So if FFL wanted a new M16, the FFL needs a police letter to get one.

Second is he used the PD to buy the guns and avoid Federal excise tax on the guns (FET). There have been a few notable convictions for this over the years.
