Good morning all. I recently purchased this Smith and Wesson AR that is equipped with a fixed stock, non threaded barrel, shark fin grip, and a removable magazine. The site I purchased it from stated it was compliant with NY state laws. I purchased the firearm and had it shipped to my FFL. I was told by my FFL that it is no longer legal for a non law enforcement agent to own this firearm and they are sending it back to the FFL I ordered it from. I’m a bit confused. Who is correct? Thanks in advance for any help you may be able to provide.

I would be interested in hearing the FFL's explanation why he thinks it's not NY legal.
I would also probably find myself another local FFL and have the guy who has it transfer it there instead of shipping it back.
There are a lot of people who make up new terms they think are in SAFE from whole cloth. FFLs are notorious for this.

The FFLs I work with would have explicitly told you the problem (e.g. the stock really isn't fixed) and would offer to fix the issue to complete the transfer.
However I think the FFL is stuck on the shark fin not being legal. I really don’t understand because the SAFE act is so clear on what is and isn’t allowed. I mean it is right there in the crystal clear definitions……. Oh wait.

Sounds like the ffl is a clown. Check with another ffl and see if you can send it there. It sounds featureless which shouldnt be a problem.
There is nothing new to the safe act. If they will have them swap it out for a spur and transfer it to you with all the parts. Or have them ship it to another FFL who doesn’t have a history of shenanigans.
Yeah contact the FFL you bought it from and have him ship it to a different FFL when he gets it back. Unfortunately this is going to cost you more money. You may want to forget DSI exists after this fiasco.

I can see an FFL not being comfortable with that.
But that's a long way from the declarative statement that it's not legal the OP reported.
If that's what it is, the FFL should have explained that he isn't comfortable, and then offered to ship it to some other local FFL who is. That would certainly be enough to CYA for him.

Sorry to hear that. Ive never dealt with them, but have heard nothing but nightmares from people about them. And they are 100% wrong about this rifle and an ffl being able to modify it. They may have to ship it back and then you gotta find a different ffl. Just check with the new ffl first.
It must be the same law that declared the Thordsen stock illegal and you could only buy their POS fixed mag lowers.

They are an FFL07 which means they can manufacture complete guns. Again they only want to push their own products. Take your business elsware.

I have a relation that happens to have the same name. He works in the "anti-terrorist" intelligence in Washington DC. He got called into the office because "they" saw my name which was his name too and asked him bout it.
At first, we laughed it off. Then the more I thought about it the more pissed off I got. Why and what were "they" doing even looking at my name as a litigant on a lawsuit in the Anti Terrorist function of the Government.
Don't think "they" aren't watching you! Not because you are a terrorist, because they can. 4473's are to be kept within the ATF and not shared unless through due process. That's a laugh! Your purchase information stays with the FFL until he/she goes out of business, they take a guess where all that paperwork goes. Im not bashing FFL's but I am bashing the 1968 GCA which spawned the FFL.
