Didn’t we already have that when a Buffalo area federal judge overruled the 7 bullitt max? Lots of blue counties were screaming that it was only good for the county that judge was from. Seems like even after 12 years people in eastern NY still believe it’s only 7 roundsIf there are no consequences, then they have no reason to ever change.
The only way to fix it os for some conservative judges to start doing the same thing. Then the left will suddenly discover how dangerous it is and we might get some rules to prevent it.
So, some minor federal judge needs to issue a nationwide injunction against boys in girls locker rooms or something.
Or better yet, gun laws.
Right now there's nothing stopping some judge in Texas from ruling that NY is violating the 2A rights of Texas citizens by not allowing them to bring their full featured suppressed rifles with them when they visit.
The real problem is that they're mostly right.Judges think they are untouchable elites for the most part.
They have what they need for enforcement.SCOTUS needs an enforcement arm. Yes, the executive branch should in theory have that responsibility but we all know that happens only some of the time depending on the issue and who is in office. If a SCOTUS Martial Service of some kind had the authority to arrest governors, attorneys general, etc. who are not abiding by a SCOTUS decision I think we'd see some real change happen fast.
They have what they need for enforcement.
They just lack the will to use it.
SCOTUS has the power to remove any of these activist judges from office anytime they want.
They simply need to declare these ridiculous rulings "bad behavior" and they are gone.
SCOTUS says they're not a judge, then they're not a judge anymore. It's that simple. There isn't even an appeal they can make. Who would they appeal a SCOTUS decision to ?How so? If SCOTUS declares that a lower court judge is willfully and persistently going against law, who is responsible for removing them? US Marshals? FBI? Local law enforcement? I also assume they would only have jurisdiction over state judges.
