Kroger Now Being Sued By 20-Year-Old For Not Selling Him Shotgun Shells
Earlier this week, we reported on an Oregon man who filed a lawsuit against WalMart and Dick’s Sporting Goods for discrimination because they would not sell him a rifle even though he was of legal age to obtain one. Now, in another story out of Oregon, a 20-year-old young man is suing Kroger because they would not sell him shotgun shells.
At the first of March, Kroger took up a policy much like that of Dick’s and WalMart in that they are determined to discriminate on sales of Second Amendment products to people under 21 years of age.
At that time Kroger released a statement saying, “In response to the tragic events in Parkland and elsewhere, we’ve taken a hard look at our policies and procedures for firearm sales. Recent events demonstrate the need for additional action on the part of responsible gun retailers.”
Yeah, responsible gun retailers sale guns and ammunition to law-abiding citizens. Instead, Kroger is choosing to discriminate based on age, something that is in violation of the law.
Breitbart reports on the plaintiff in the case.
In court filings possessed by Breitbart News, the plaintiff, Airion Grace, claims that the purchase refusal is “unlawful age discrimination.”
Grace attempted to buy shotgun shells at a Washington County Kroger subsidiary, Fred Meyer, “on or about March 6, 2018.” He went to the gun/ammunition counter in the store, asked for a box of shotgun shells, and was told he could not purchase them because he was not 21.

Grace claims this policy violates Oregon’s law against age-based discrimination for those 18 years and older in places of public accommodations. The state law includes prohibitions against discrimination in stores that are open to the general public.
Grace seeks:
Tyler Watson also filed suit against WalMart and Dick’s when he attempted to purchase a rifle and was discriminated against due to being under 21, but of legal age to obtain a rifle.

- Injunctive relief requiring Defendant to stop unlawfully discriminating against 18, 19, and 20-year-old customers at all Oregon locations.
- Punitive damages.
- Reasonable costs and attorney fees.
- Such other relief deemed just and equitable.
