Justified. Bad guy/aggressor showed every intent to inflict violence and was not deterred by verbal warning.

Leg shot was a nice move in this case. I doubt I'd have made that decision. My sights would have been center mass (which would have made the outcome worse for everyone and I don't need that level of shit in my life). I hope never to be in such a situation.

This scenario in NY...I would bet the DA would have charges brought against us.
Sadly, unless the aggressor had a deadly weapon visible, the DA's would expect your "duty" to retreat....or take-your-beating-like-a-man...
At my age, I can't run very far..so I would do what that guy did...

If we're talking about NY Art 35 I'd say on the surface it would likely be a bad shot but we don't know all the facts. Who was the initial aggressor? Gun was drawn from beginning of video was the guy who was shot responding to a potential mugging? In any event he was clearly not using or about to use deadly physical force. I believe shooting would be considered deadly physical force even if to the leg so response is not justified under Article 35. There was also no apparent disparity of force or other impediment that would likely put shooter in a position where he would be in fear of his life. Shooter could also have continued backing away. I suppose it would come down to how good his attorney is lol. JMO.

This is why you must always be aware of your surroundings, like where the cameras are, witnesses, you know the thing.

I believe in NY he would be in a world of trouble. From the video, it looks as though he may have been able to retreat.

It was mentioned somewhere above, but unfortunately, in this state you would probably have to take a couple whacks before pulling the trigger.

Yes he could argue self defense, and may even win, but will be broke for the rest of his life trying to defend it. This situation was not worth that.

If he would have made an attemt to retreat, or else was surrounded by another aggressor, I would say good shoot.

Well in New York (as it's been explained to me) you're going to be detained in handcuff at least initially, and you should make absolutely no statements, no apologies, other than to the Officer with your request that he speak to you Lawer before asking ANY questions what so ever.
A Grand Jury is going to hear the case and decide whether to indict or no-bill which is a good thing because now the case has been evaluated and a decision was made to its justification.... sucks yes, so does physically fighting where the outcome seldom goes as planned.

That's why my very first reaction was laughter. It reminded me of the newest jackass movie where steveo put a ton of bees on his crotch and his reaction. It was one of semi shock. Like what did he think was gonna happen lol? This guy was dumb enough to continue to try and fight a guy that had a gun pointed squarely at him and gave him multiple opportunities to just walk away. This wasn't like the unarmed guy had to fight for his life and take his chances against an armed robber or something. There is no shortage of stupidity in the world.

The guy was a moron but the DA will probably say that the shooter had room to turn around and try to run away. DA's try to make their mark by convicting people needlessly. They will likely say that 'stand your ground' does not apply here, if it indeed in effect wherever this video was taken.

My take is that it was self-defense. What rational person persists on infuriating a gun owner (assuming that he has a valid CCW).
