Dear Mr. ,
Thank you for contacting me regarding gun laws and regulations. It is good to hear from you.
Since coming to Congress, I have worked hard to keep Central New Yorkers, and our entire nation, safe. Like many of my constituents, I believe in the importance of preserving and protecting every law abiding American's right to own a firearm. However, I recognize that there is an unacceptable level of gun violence in this county and that we need to take thoughtful, sensible action to keep guns out of the wrong hands.
As a former federal prosecutor, I spent over twenty years prosecuting violent offenders and working to keep our community safe by enforcing our current gun laws. I've seen firsthand that local law enforcement does not have the support and resources that they need to enforce the laws currently on the books.
Following the attacks in Las Vegas, as well as so many other senseless acts of gun violence that have taken place around our country, there is no question that we must do more to keep Americans safe. But we must do so in a lawful manner that fully respects the Constitutional rights of all Americans. In order to curb gun violence, we need policies that increase support and resources for our local law enforcement and for our intelligence communities.
As you may know, federally licensed retailers are required to run a background check through the FBI's National Instant Criminal Background Check System (NICS) when transferring a firearm to an individual. However, because the Federal Government cannot mandate state participation in NICS, many states do not provide all records that may prohibit an individual from owning a firearm under current law. It is imperative to the safety of our communities that all states provide the relevant records to ensure the databases are complete and accurate.
Simultaneously, it is critical that we address mental health in this country by helping to treat individuals who suffer with mental illness and prevent them from harming themselves or others.
It is also vital that we ensure terrorists do not have access to guns -- which is why I supported legislation last Congress to prevent terrorists from obtaining firearms, while ensuring that the rights of law-abiding Americans are not abdicated without judicial process.
Meaningful and effective reform will only come if we do more to improve background check systems, actually identify those individuals who pose threats, improve access to mental health care, and work to counter radical extremism.
As legislation related to this issue comes before the House for a vote, I will keep your thoughts in mind.
