The problem is this...

“an executive branch memorandum can preempt state law”

So then, the "Executive" can preempt law, when convenient for political purposes only! ie, here shown providing an exemption to law to a "class" of people (criminal migrants).

Contrastingly, the "Federal" Executive is disallowed to "Preempt" Immigration law opposing the same class of people from being processed and deported.

Hmmmmm....

Seems the "Courts" lately are doing a bit more than just ruling based upon "Law" and "Precedence" and creating new legal paradigms by either action or inaction associated with particular political prejudice.

EXACTLY, every since Chief Justice Marshall created judicial review in 1803 out of thin air, the Court has continued to usurp power from the other branches and in this case state government.
