So some folks in California weren’t paying attention and missed the window, and in New York we might not have noticed, that the Duncan decision struck down the California magazine capacity limit a week ago Friday, resulting a week-long MAGAzine free-for-all in California, until the judge temporarily partially stayed his judgment on appeal. Although it is far from final, this was a huge win. And the gun community in rest of the country surely noticed, as all MAGAzines were shipped to California en masse.
The stay went in effect Friday, and 30 and 20 round AR15 magazines are still sold out at most online retailers; not only that but 30 round magazine springs are also sold out.
All those MAGAzines that were bought, converted, or “found” in California last week (millions, quite likely) are still legal to possess and use under the judge’s stay.
Our little NYSRPA v NYC case is not as big a deal but it is ahead of Duncan for the Supreme Court, and a win in NYSRPA would be great if Duncan could make it there too and free MAGAzines nationwide.
Realistically it may be overruled in the 9th circuit and the Supreme Court might not then take it. We shall see. Let’s hope that they win the lottery in the 9th circuit and it goes straight to SCOTUS to resolve the circuit split in favor of the 2A. Although I would feel better about that too if RBG had been replaced.
Anyway well done for California gun owners and the manufacturers. There’s a hell of a lot of decent magazines in the worst state for gun laws in our nation and that has got to have Pelosi’s knickers in a twist.
