He told the cops nothing happened and the gunshots must have been elsewhere, later changed the story to firing a warning shot, chambered another round, then tripped on a nail and fell because he's an old man, and the gun went off by itself and fired into the car by accident. He testified to this story at trial. Jury did not buy this yarn.

Supposedly the gun did fire in a state police drop-test. I suppose it will probably be held and eventually destroyed after all appeals are exhausted.

His long private drive was mistaken for a roadway....... Kids were probably high or partially drunk........reason for their mistake...........party was probably going to be at a dive house..........or a similar dead end road's parking area...............sex, drugs, rock and roll and campfire on the menu is likely.

Maybe a burglary of convenience? Gathering Firewood would have taken some time.............were they armed at all? No reports of weapons is in the record.

Trying to scare them away did not work well.............so he is convicted of Manslaughter.

Turning around 3 vehicles was going to be complicated and take a while...a real clusterfuck in the making.........

The guy was a bit paranoid............. a perfect mix of assholes vs asshole.

We get 2 am tresspassers trying to steal gas, regularly on my road.......so we keep the tanks low to fuck them.........works well............very angry body language is seen on the video. 4 wheeler guy is a turd.........kicks my truck and hits my house..............and quiet car guy, is a tatooed felon........
My neighbor had a golf cart stolen off a trailer and driven away by these scum...........it was found in the Mohawk River in Rome, across from the Savoy Restaurant.........


It ain't worth shooting a thief over $25 gasoline.........when all he will get is an appearance ticket and keep it up, or worse................gotta pick your fights.............inside your home.

It says murder, not manslaughter, right in the headline. And the kids were consistent and had corroboration that they simply got the wrong location and driveway in a rural area with no cell signal for navigation. They didn't do anything wrong here other than the extremely petty matter of driving up the wrong private drive. If you're that teed off by unwanted visitors in your driveway then install a closed and locked gate. That's a thing. There's been zero evidence for the rest of your bad-faith speculation.

If your takes are this consistently wrong then really you are "making gun owners look bad" as much as this guy, and I hope you don't get involved in something similar.

I remember back in the day people weren’t so paranoid about others coming on to your property or up to your door. I can recall a time when people were genuinely happy to help you out with directions or a bit of gas or jump your dead battery or most anything else for that matter. It’s fucking sad how paranoid our society has become.

I can tell you that in the last few years, people have been building new homes far off the main roadway, far enough that you cannot see the new homes.

Why? PRIVACY..................

These are definitely "no go" zones..............

Seeking a safe spot to party at..................far from the main roadway.........WHO WOULD DO THAT?

This will happen again.

Same for the police. A lot of lazy ones out there that won't help try to get you out of the roadway. Instead, they'll just plop their cruiser in the middle of the road with their lights flashing instead of clearing the roadway or helping the poor sap out with their car.

Several years ago, I was coming home late one night, I had to fuel up my truck, and there was a conked out car in the middle of the road that a young man was driving. Chatted with him and learned that he lived a few streets down from me. The police weren't there yet, but I pulled my truck around from the gas station to get an additional set of hazards going. I got out of my truck, put my gloves on, and no sooner than I did, the NYSP come with their lights on. The officer gets out of their cruiser and asked what happened. I told the officer that the young man's car broke down and we were moving it out of the roadway like 30 feet into the gas station lot so a tow truck could get it.

The officer asked me if I was related, and I told him no. The officer then told me that I wasn't allowed to remove the car off the roadway and to get my truck out of the road and leave. I asked why, and he said that I'm not a wrecker service. I looked at the young man, and I shrugged. I got back in my truck and pulled the few feet into the gas station and got out and leaned against my truck and listened and watched. The officer asked the young man for his license, registration and insurance. Then started questioning him for quite a length of time with all kinds of questions. After the officer got what he wanted, he told the young man to sit in his car and wait for the tow truck. The young man asked if he could be with me instead saying he felt uncomfortable sitting in the middle of the road in his broke down car. The officer told him no, so the young man got back in his car and waited. I started walking to the curb, and the officer was watching me like a hawk. The young man rolled his window down and I was chatting with him for over an hour till the tow truck arrived.

Once the tow truck came, the officer let the young man leave the car and I drove him home. That was his very first experience with police driving and he said he was very, very scared and was very glad I stayed. I told his parents what happened and their eyes were the size of half dollars! They were appalled!

Last night, similar situation. I was coming home, a car got rear ended, and debris strewn across the roadway. Instead of the officer directing traffic to avoid other vehicles running over the debris, which could cause another accident or a blow out, nope, they were just sitting in their cars watching poor saps who were rubber necking run over all kinds of debris. I stopped on the shoulder, turned my hazards on, let the traffic pass by me by, and once there was no more traffic, I carefully manipulated my way around the debris. More so I just spend over $1,000 for new tires that don't even have 5,000 miles on them yet...

This is senseless. But lets back up a step or two. We have 315+ million people in this country. with about 5 times as many firearms, there is bound to be a nutcase running around. There IS going to be tragedies, mistakes and death and there isn't anything we really can do about it. Hopefully we can keep the mistakes, accidents, tragedies to a minimum.

If the elite wanted to do away with firearms, they should have done it in 1776

People have been doing that forever. Even back in my younger days the other kids were seeking places away from "authority figures" to party. One could argue the basic underlying premise of Woodstock was a desire to be away from where police would be so they could enjoy loud music and drugs.

I suspect that it was impolite.....................guy built a home far off the beaten track because he was paranoid................seeking a spot to party, may be like camping in Africa.

Franky, this sends big message to the area drug using class, looking to party-harty.

Was not just some forlorn woman who simply got lost in a convoy................ SHE LIVED IN THE AREA.....................looking for medical aid??...she had a smart phone, I can assure you as did the other nighttime tresspassers.


What happens after 9 pm at night?

Did the homeowner have internet? Smart Phones? Yes, he did.........someone called the cops with an "inoperable" cell phone. How did this happen?

What if the convoy had been Illegals looking to set up a temporary camp? Or the home invasion that the homeowner suspected was going on........10pm, nighttime....3 vehicles..............I can understand his mindset.


The time line is confusing.............kills girl.............nothing happens for a while??..BS!!!!


I have video of the occasional trespassers checking my vehicles for unlocked doors..........and wanting/actually stealing gasoline..............they have no fucking idea. I confront no one outside at night..........as they might be armed and make an even-steven fight over gasoline. Never put your self at such a tactical disadvantage....

Property is not worth it......

I suspect an appeal will happen..............case will likely be reduced to a manslaughter conviction or a new trial will happen..........mistakes in the case..........bad Lawyer......Castle law is not NYS law but the law, over perceived danger is clear, and accidents do happen, like Alec Baldwin............I suspect the Jury was inflamed by the mans actions, not understanding his mental state after the crime............
