“I agree with a lot of what Mr. Ader said,” he said. “To say this was a dumb thing to do is an understatement. I can’t figure out, other that you’re desire to have money, why you did it. You are an intelligent young man, capable, you earned money before. You do have support of your family, you don’t have any real criminal record and you haven’t been to jail before.

Zambito said he has “gone back and forth” on what sentence to impose.

From what I know of judge Zambito he is a fair and honest judge that believes in second chances . He obviously saw something in this kid that deserves mercy. Now if Coles ever appears in front of Zambito in the future he would receive a relatively harsh punishment.

Just a side note: judge Zambito primarily issues unrestricted pistol permits and views gun ownership as a right , not a privilege.
And no Zambito is not a relative of mine , just a fair judge that allowed me to exercise my rights and issued me a pistol permit where as our former county judge likely would not have .

Should have been 10 years per gun. If they are serious about this type of shit (which I know they are not!!), they would impose a VERY harsh sentence. We also have to make the prisons a miserable place to be, so the career criminals will rethink their career choice. This bullshit of them being treated well enough, and feeling quite comfortable in prison, that they are willing to take the chance of going back, is an absolute joke!!

Keep 1 thing in mind... The governor who makes the laws no one like is elected by NYC and now the courts who are sentencing these crimes are the more republication supported towns. Take NYC out of the equation NY is A LOT less liberal, and Andy looses most counties out of the city.

10 yrs a gun is a life sentence plus in this case. 140 years. With that type of jail time across the justice system you might not like the tax increases. I think five years is a plenty fair sentence where his only prior was pot in college, they recovered all the guns in his possession, and he stole them from the shop when no one was there. Five years is not a short sentence for a property crime.

The stupid law about magazines being outrageous has nothing to do with what is a fair sentence for this guy. But on that point, Simeon Mokhibar got probation and no jail for 3 felonies for 3 standard-capacity magazines. Hopefully he gets that law thrown out on appeal, but it's not like the judge sentenced him to 30 years in prison.

My point is that the gun-grabbing socialist/libs, and msm scream about guns, and how they end up in the wrong hands. We all scream about how lenient the laws are on the actual criminals, yet we're saying things like: maybe this is his 1st "real" crime, OR, at least they recovered ALL of the stolen guns. Should the penalty be higher if 1 gun was gone, or even higher for the 2nd gun? I'm just trying to understand here is all?

This wasn't some petty crime here, this was serious stuff. Keep in mind here, that those guns could not have been sold to a legally in NYS, due to the requirement of the FFL transfers. So if his true intent was to sell the guns, they would have had to be sold "on a street corner". Guess who buys them??

As far as I'm concerned, a 5 year sentence should be reserved for the guy who breaks into my garage!!!

As far as I'm concerned, I want the guy that breaks into my garage to get a stiffer sentence than someone who breaks into a business after hours. That's burglary of my home where I live. Maybe not quite into the living area, but close enough. Invading my castle where I live and sleep is a different matter from invading my business, and it's not just about property any more.

I'm not saying it's a petty crime, I'm saying 5 years in prison and a felony record isn't a petty sentence. Especially not for a first property crime.

Anybody who personally knows me, knows that if there's 1 thing I hate it is a thief. Doesn't matter if it's my shit, or WalMart's shit. NO ONE has the right to decide that because someone owns something, (that they've earned, YES, even WM has earned their shit!!! Like it or not, it's a fact!!), that the thief thinks it is alright to steal it from them. If they'll break into a business, or steal from the local hardware store, they will sooner or later see something that someone else owns, and decide it should be theirs. A freaking thief, is a thief, they have "zero" boundaries. It's my shit, leave it the hell alone.

That's what makes America such a GREAT Country,.... if you want something, just go out and earn it. Sure some people may be able to get it sooner because they make more money, BUT anyone who is willing to work hard enough can get what they want,.... WITHOUT STEALING IT!!!
